AMERICAS BRAZIL The Brazilian Ministry of Economy authorized1 the making of advance payments in tenders and contracts during the state of public calamity, as long as it is indispensable to obtain the good or ensure the provision of services. This device can also be used when the advance generates significant savings for public coffers. The Ministry of Economy also instituted2 an extraordinary fiscal, financial and contracting regime to deal with public calamity resulting from the pandemic. The measure, originating from the “PEC of the War Budget” (PEC 10/2020), simplifies the federal government's expenses to combat the coronavirus pandemic and will run until December 31 of this year. CANADA The Office of the Superintendent of Financial Institutions revised3 the Directives of the Superintendent pursuant to the Pension Benefits Standards Act, 1985 (the Directives) to provide the Superintendent’s automatic consent to portability transfers to locked-in vehicles for members who are eligible for early retirement subject to specific conditions. UNITED STATES (FEDERAL) House Democrats are expected to introduce a new COVID-194 relief bill this week as House Majority Leader Steny Hoyer told representatives that the House will not vote on its next coronavirus relief plan before Friday. UNITED STATES (STATE SPECIFIC) As of 8am EST on May 11, 2020, there are 727 pending COVID-19 Legislations throughout 29 states. A total of 1,305 COVID-19 related bills have been enacted and proposed in the U.S. The high level summaries are included below. Over 300 executive actions have been issued in 50 states, Puerto Rico, the District of Columbia, Guam, and the Virgin Islands. Over 1,120 executive actions have been issued in total Over 145 bills have been introduced in 42 state legislatures, Puerto Rico, the District of Columbia, the Virgin Islands and Guam related to paid sick leave and worker protections as well as appropriations requests Over 30 states and the District of Columbia have issued emergency regulations on a number of issues including but not limited to insurance carriers, labor and wage, and medical licensure As of May 8, 2020, at least 18 legislatures (Alaska, Arizona, Colorado, Delaware, Georgia, Guam, Hawaii, Illinois, Iowa, Kansas, Nebraska, New Hampshire, New York, Northern Mariana Islands, Rhode Island, South Carolina, Tennessee and Virgin Islands) have postponed their legislative session. ISRAEL 2020/05/10 Banking Supervision Department announces comprehensive framework for deferring loan payments8 The Banking Supervision Department has established a framework for the deferral of loan repayments in 3 activity segments (mortgages, consumer credit, and business credit), allowed annual reports and tax refund requests to be filed online and expanded a package of assistance to businesses operating in particularly high-risk industries from NIS 80 Billion to NIS 100 Billion. UK 2020/05/11 TheCityUK sets out work to recapitalise the post-COVID-19 economy12 TheCityUK has today written to Bank of England Governor, Andrew Bailey, to share analysis on the potential level of unstainable debt held by UK businesses in light of the COVID-19 pandemic and set out its approach to finding industry-led solutions to recapitalise these businesses and support the economic recovery. 2020/05/07 Law Society statement on virtual execution and e-signatures13 The Law Society has issued a statement of its position on the use of virtual execution and e-signatures during the COVID-19 pandemic. The Law Society notes that the law relating to virtual and electronic execution has not changed since the outbreak of the pandemic, and goes on to list factors that should be taken into consideration when executing documents. The Law Society has also updated its practice note on electronic signatures to reflect COVID- 19, including: Its position on witnessing. HM Land Registry's temporary relaxation of its requirement for an original wet ink signature for registration purposes. 2020/05/07 COVID-19 Update 7 May 202014 The FRC has published the latest edition of its COVID-19 Update, in which it notes that its Audit Quality Review, Corporate Reporting and Professional Oversight teams will resume their full programme of supervisory work from 11 May. It will also resume inspection and supervisory work with audit firms. However, it will relax its expectations regarding deadlines for responses where appropriate.
