Work includes paving and stripping an existing gravel lot on the western side of the Charlotte Central School property 1.03 ASBESTOS CONTAINING MATERIALS – NOTICE TO CONTRACTORS A. The use of asbestos or asbestos products will not be permitted in any form in the construction project for any new work. Discover of any such material is cause for rejection. 1.04 AVAILABILITY OF DOCUMENTS A. Champlain School District, Shelburne, VT (herein called the "Owner") invites Bids for the following project: Charlotte Central School – Site Improvements B. Bids will be received at place and time indicated in Notice to Bidders. C. Electronic mailed bids only. Owner invites Bids on Work described in notice to Bidders. B. Base Bid prices on lump sum. See Bid forms for specific requirements regarding bids, alternate & unit pricing and other cost breakdown information. 1.03 BIDDING DOCUMENTS A. The bidding documents include the Invitation to Bid, Information for Bidders, the form of proposal, bid bond, non-collusive bidding certificate, A.I.A. document A101, Division I - general requirements, the project manual and specifications, the drawings, and all Addenda issued prior to opening of Bids. 1.04 BID SECURITY A. Submit bid deposit in the form of a certified check, treasurer’s or cashier’s check (issued by a responsible bank or trust company) payable to the Owner or Bid Bond on form furnished herein, duly executed by Bidder as principal and having as surety thereon, Company authorized to issue Bond, in amount of 5 percent of Bid. B. Agent who signs Bid Bond must file with Bond certified and effectively dated copy or his power of attorney showing any limitation in regard to total amount for which any single Bond can be issued. C. The bid deposit will be retained from all bidders until a contract is executed. Upon contract award, bid deposits will be returned within ten (10) days. D. Bid deposit is considered forfeited to the owner, as liquidated damages, in the event that a successful bidder fails or refuses to execute and deliver the contract and bonds required within ten (10) days after issuance by the Owner. 1.05 PREPARATION OF BID/TENDER A. Submit on forms furnished herein. B. Fill out in ink or typewritten, without erasure, interlineations or changes. C. Make Bid in name of Principal; if co-partnership, give names of all parties. Indicate on bid form the date work is to commence and number of consecutive calendar days or specified date, in accordance with indicated format on bid form, in which construction will be completed. E. Fill in all blank spaces for bid prices in both words and figures. F. Failure to submit the following documents may cause the bid to be considered irregular: 1. Bid Form 2. Bid Deposit 3. Certificate of Corporation, if bidder is incorporated 4. Non-Collusive Bidding Certificate 1.06 NON-COLLUSIVE BIDDING CERTIFICATE A. Each Bidder submitting a bid for any portion of the work contemplated by the bidding documents shall execute a non-collusive certificate as required, in the form herein provided, to the effect that he has not colluded with any other person, firm, or corporation in regard to any bid submitted. Such certificate shall be attached to the bid. Failure of any bidder to abide by this provision shall be cause for rejection of submitted bid 1.07 SUBCONTRACTORS AND MATERIAL SUPPLIERS A. The successful bidder for each Contract shall submit to the Architect after receipt of notification of award of contract, a list of subcontractors, material suppliers and manufacturers proposed for the various portions of the work. 1.08 CONDITIONS OF THE CONTRACT AREAS A. Each bidder must inform himself fully of the conditions relating to the scope of work, project conditions, and employment of labor thereon. Failure to do so will not relieve a successful bidder of their obligations to furnish all material, labor and equipment necessary to carry out the provisions of the contracted scope of work. The Contractor, in the carrying out the work, must employ such methods or means in a manner not to cause interruption or interference with the work of other contractors or the operations of the Owner. 1.09 OBLIGATION OF BIDDERS & CONDITIONS OF THE CONTRACT AREAS A. At the time of the opening of bids, each bidder will be presumed to have inspected the site, to have familiarized himself with local conditions, and to have read and to be thoroughly familiar with the bidding documents, including all Addenda. The failure or omission of any bidder to receive or examine any form, instrument, or document shall in no way relieve any bidder from any obligation in respect to their bid. 1.10 SCHEDULE A. The project schedule is intended to occur as follows: 1. Commencement of work upon notice to proceed (plus/minus June 15th or earlier with district permission). Completion by August 15th 2021. B. The Contractor, in full cooperation of School Officials, shall coordinate the development of a construction schedule with complete coordination with the School District Calendar; final schedule must be approved by the School District. C. The School Department reserves the right to authorize and begin work earlier then indicated above at no extra cost to the school district. Early scope activity that does not impact school occupancy or existing contract work may be approved for commencement of construction in specific approved areas as early as June 15th 2021 with written approval & notice to proceed Colin P. These activities may include site preparations, excavation, demo and exterior utility work all for which has no impact on school operation and function. D. Contractor, prior to site mobilization, shall anticipate adequate time and effort for preliminary exploratory demolition, field survey verification, and other miscellaneous project and prep work as required to anticipate and align the project schedule as required to meet the district schedule requirements and expectations. 1.11 ASSESSMENTS AND TAXES A. Exemption from Sales Tax: The Sales and Compensating Use Taxes of the State of Vermont and of cities and counties do not apply to purchases and sales of material and supplies pursuant to the provisions of this contract. These taxes are not to be included in bids. This exemption does not, however, apply to tools, machinery, equipment, or other property leased by or to the Contractor or a Subcontractor or to materials and supplies of a kind which will not be incorporated into the completed project. B. Other Assessments and Taxes: Each bidder shall include in his base bid proposal all other costs and liabilities other than that excluded in paragraph A above for the amounts assessed under any sales, consumer use, or other similar tax, any assessment or taxes upon the wages and salaries paid to employees of the Contractor and his Subcontractors under the Contractor, or any other taxes assessed by the Federal, State, or Local Governments. C. Bidder is responsible to ensure tendered bid is in conformance with all federal, state and local tax rules and regulations for work performed under contract with the Champlain Valley School District. 1.12 INTERPRETATIONS A. If bidder for proposed work is in doubt as to true meaning of any part of Contract Documents, submit written meaning of any part of Contract Documents, submit written request to Architect/Engineer for interpretation. Bidder submitting request is responsible for its prompt and actual delivery. Interpretations will not be made orally. Architect is not responsible for any other explanations or interpretations which anyone presumes to make. B. Submit written request for interpretation to Colin P. Lindberg, 208 Flynn Avenue Suite 2B, Burlington, VT 05401, or by electronic mail to randy@colinlindberg.com. Request must be received by date as indicated on document 00 0200 Notice to bidders. C. All interpretations or supplemental instructions will be in form of written addenda prior to date fixed for opening of bids. Copy of such addendum will be posted as indicated in notice to bidders (section 00 0200) under availability of documents. Contractor shall ensure retrieval of all issued addenda. Failure to receive or obtain such addendum does not relieve bidder from any obligation under the bid as submitted. Addenda are a part of the Contract Documents. 1.13 WITHDRAWAL OR REVISION OF BID A. Bids may be withdrawn or revised prior to scheduled time for bid opening, under following terms: 1. Bidder may, without prejudice to himself, withdraw Bid after it has been deposited, provided request for such withdrawal is received in writing or by telegram, before time set for opening. Telephonic communications are not acceptable for such request. 2. After bid opening, no bid may be withdrawn for period of 90 days. 1.14 IRREGULAR BID A. If there are unauthorized additions, conditional bids, or irregularities of any kind which may tend to make Bid incomplete, indefinite, or ambiguous as to its meaning. 3. If bidder adds any provisions reserving the right to accept or reject any award, or to enter into Contract pursuant to an award. 4. If unit or lump sum prices contained in bid schedule are obviously unbalanced either in excess of, or below, reasonable cost analysis values. 5. If bidder fails to insert alternate and unit prices for every item indicated. 6. If bidder fails to complete bid in any other particulars where information is requested so, Bid may be properly evaluated. 7. If form furnished is faxed. 8. If Bond or Non-collusive bidding certificate is not used. B. Owner reserves the right to reject any or all Bids and to waive irregularities or informalities as may be deemed in Owner's interest. 1.15 PRIORITY OF ALTERNATE BIDS A. Post bid submission; alternate bids are to be selected by owner with considerations to both budget and other district priorities as determined by owner. B. The owner reserves the right to accept or reject any alternates in any order or combination, unless other wise specifically provided in the bidding documents. 1.16 METHOD OF AWARD A. Contract award shall be to the lowest responsible bid conforming to the specifications. B. The lowest responsible bid shall be determined by the sum of the base bid and accepted alternates. C. The owner reserves the right to select a contractor when the two lowest responsible bids are within one percent of each other. D. The owner reserves the right to reject any bid found not to be responsible or conforming to specifications or to reject all bids. 1.17 LETTER OF INTENT TO AWARD A. Upon issuance of letter, by owner, of intent to award contract, bidder may not withdraw bid for period of 90 days from dated letter of intent to award. 1.18 EQUIVALENT PRODUCTS & SUBSTITUTIONS DURING THE BID B. The work of this project includes the furnishing of all labor, materials, appliances, tools, equipment, and the performing of all work in accordance with these specifications and the drawings, except for work which is expressly noted herein or indicated on the drawings as not included in the project. B. The site of the work is located at: Charlotte Central School 408 Hinesburg Road Charlotte, Vermont 05445 C. The Project consists of one contract as follows: 1. GENERAL - The work includes the following general construction components a. See description of work in section 1.02 Notice to Bidders document 00 0200. b. Site access, security and damage prevention measures (refer to Part 1.09, Building Security & Damage Prevention). c. Contractors shall visit the job site before the Bid and familiarize themselves with the existing conditions pertaining to the Work. 1.02 LAYOUT OF WORK A. The Contractor shall lay out the work according to all plans, shop drawings, details, and instructions of latest issue. 1. Maintain one complete set of up-to-date drawings, specifications, shop drawings, details and instructions on the job. B. Work shall be laid out plumb, square and true, to exact and correct dimensions. Work incorrectly laid out shall be removed and properly built at no extra expense to the Owner. C. Work shall be laid out with regard to the work of others so that all work shall fit and form good joints. 1.03 CORRELATION OF WORK A. Each Contractor, and any Subcontractor requested by the General Contractor shall be required to attend regularly scheduled job meetings and special job meetings when called by the Architect. Decisions required from the Architect shall be anticipated by the Contractor to provide ample time for inspection, investigation, or detail drawings. 1.04 EQUIVALENT PRODUCTS & SUBSTITUTIONS DURING THE BID A. Wherever a material, article, or piece of equipment is identified on the Drawings or in the Specifications by reference to the name, trade name, make or catalogue number of any manufacturer or supplier, it is intended to establish a standard of quality and/or performance, as determined by the Architect, and not to limit competition. Wherever in the Contract Documents one or more products are specified, the words "similar and equal to" shall be deemed inserted. B. Written requests concerning the use of the proposed substitute must be received by the Architect at least 10 days before the time of the bid opening. Written requests shall be accompanied by complete specifications and performance characteristics covering the product, together with test data and experience records. C. When the Architect approves a product proposed by the Contractor and such proposal product requires a revision or redesign of any part of the work of this Contract or any other separate Contract, all excess costs occasioned by redesign, revisions, or extra work which is required by this or other Contracts shall be at the cost and expense of the Contractor proposing the equivalent. 1.05 REFERENCE STANDARDS A. All documents and publications such as codes, standards, and specifications which are cited in the project specification are hereby made a part of the project specification to the same extent as if printed and bound herein. B. Wherever reference is made to any such document, the Contractor shall comply with the requirements of the issue or edition including revisions, amendments and supplements hereto in effect on the date of the Notice to Bidders of the Project, except as modified by the Project Specification. 1.06 DISCRIMINATION A With the acceptance of this Contract, the Contractor assures compliance with all applicable State and Federal rules, regulations, executive orders, and legislation relative to equal opportunity and/or affirmative action in employment practices. 1. National_VII_of_the_Civil_Rights_Act_of_1964 prohibits discrimination in employment on the basis of race, color, religion, national origin, or sex. 2. Equal_Pay_Act_of_1963 prohibits salary discrimination on the basis of sex. 3. Section 504 of the Rehabilitation_Act_of_1973 prohibits discrimination against any employee or application because of physical or mental handicap in regard to a job for which the individual is qualified. 4. Vermont_Fair_Employment_Practices_Act prohibits discrimination on the basis of race, color, religion, national origin, sex, ancestry, place of birth, or physical handicap. B. In a determination of non-compliance, this Contract may be cancelled in whole or in part and the Contractor declared ineligible for further contracts with the Owner. 1.07 LABOR LAWS AND MINIMUM WAGE RATES A. Each Contractor and Subcontractor performing work on this project shall take notice that all occupations employed under contract shall be paid an hourly wage rate not less than the minimum rates required by law and/or applicable ordinance. B. It is the contractor’s obligation to inform themselves of all wage requirements and regulations, wage reporting procedures and posting requirements of all employee wage awareness signs. C. The Contractor shall provide statutory benefits for disability benefits, workmen's compensation, unemployment insurance, and social security. 1.08 WORK SITE RESTRICTIONS A. Use of intoxicants or the use of other than officially provided and designated facilities, or improper conduct, to include foul language, will be grounds for dismissal of any employee. B. The use of tobacco products is strictly prohibited on the Owners property, violation of this requirement will be grounds for dismissal of any employee without warning or notice. C. With exception of law enforcement officers in the performance of his/her duties, the use and/or possession of any weapon is strictly prohibited on or within defined proximity limits of the Owners property, as governed by law. Violation of the regulation will be grounds for dismissal of any employee without warning or notice. This includes sporting and hunting rifles, bows, knives and other weapons stored (securely locked or not) in personnel or company pick up trucks and automobiles. D. Contractors and their employees are required to follow all federal, state and local laws, codes and School District Rules all of which are incumbent on the contractor and it’s employees to become fully aware. E. Contact with students is strictly prohibited. Failure to comply will be grounds for dismissal of any employee. 1.09 BUILDING SECURITY & DAMAGE PREVENTION A. The General Contractor is responsible to secure and control access to the work site at all times throughout the duration of the project. After hour security measures are necessary to prevent building access. Additionally, measures are to be taken to prevent damage to existing building and property from the elements (Precipitation, Wind etc.) B. The General Contractor will be responsible to replace damaged or missing property as a result of improper security and environmental prevention measures. The General Contractor will be responsible for all job site safety both during and after normal working hours. The job site consists of the entire continuous property limits. Colin P. The Contractor shall install approved barriers erected to prevent building and site damage due to inclement weather during times the work site is not attended to (ie. After hours and weekends). All erected fences and barriers may not impede life safety egress from buildings or other enclosed spaces (provide gates and doors as required to prevent access, but allow safe egress as required for building occupants). D. The Contractor shall submit to owner, for review only, within 10 days of award of contract a detailed Security Plan indicating location of fencing, access points, material storage locations, security, gates and protection prevention & egress procedures that are to be followed. Owner may reject submitted plans and request revised security plan at no additional cost to owner. The contractor is obligated to safeguard the site, property and personal safety for the duration of the project. 1.10 PRE-CONSTRUCTION, SITE INSPECTION & EXPLORATORY DEMOLITION A. The intent of the pre-construction, site inspection (prior to project mobilization) is to expedite the submittal process and material delivery to the site. B. The General Contractor is responsible to inspect and field verify all existing conditions and dimensions as required for coordination of shop drawings and other necessary submittals. C. General Contractor shall coordinate with owner an approved schedule for access to site prior to mobilization. Contractor shall expect to have access during school vacation periods (and other available dates and times as directed by owner) in order to conduct necessary site inspections and exploratory demolition. D. General Contractor shall patch and repair all affected areas and finishes upon completion of exploratory demolition. 1.11 WORK IN CONFINED SPACES A. Where applicable, each contractor and subcontractor performing work in confined spaces shall meet all local, state & federal rules, regulations, executive orders, and legislation relative to work conducted in confined spaces including all necessary employee training and certification where applicable. 1.12 BUILDING PERMITS A. School department to cover cost of building permit fee. B. All other trades are to carry cost for respective permit fees. 1.13 TESTING A. Fee’s and cost associated with testing, but required to be coordinated by contractor, to be paid for by owner. See specifications where applicable. 1.14 POWER A.
