1 INTRODUCTION 1.1 PURPOSE OF THESE GUIDELINES These guidelines explain the Krafttak for kreft 2019 application - and evaluation process, with an aim to ensure quality and impartiality throughout the process. To get your application right the first time, you will need to read these guidelines carefully. We also recommend that you familiarize yourself with the contents of the guidelines’ Appendix. 1.2 ABOUT THE NORWEGIAN CANCER SOCIETY The Norwegian Cancer Society’s aim is to work to prevent and fight cancer, and to ensure the best quality of life for patients and their families. We work continuously to improve public awareness of the prevention and treatment of cancer. Through research, prevention, information, support, advice and lobbying, we fight cancer locally, nationally and globally. See our Strategy 2016-2019 for more information. 1.3 USER INVOLVEMENT IN RESEARCH A more user-oriented cancer care is highlighted as a separate goal in the Norwegian Cancer Society´s strategy. The main premise is that user involvement positively affects the quality of health care, contributes to more relevant cancer research, and makes research more accessible. The Norwegian Cancer Society focuses on the end users of research results. User involvement is particularly relevant for cancer-related patient- and practice-based research. This also includes basic cancer research, which has a potential long-term impact on patients and their next of kin. We strongly encourage including users as active participants in research projects, either as consultants or collaborators. See our user involvement resource page for more information. 2 FUNDING SCHEME The “Krafttak for kreft” funding scheme will award funds to establish two «National Groups of Expertise», one for lung cancer and one for pancreatic cancer. The funding scheme is aimed to stimulate cooperation across different research disciplines and contribute to the translation of basic knowledge and methodology into knowledge that significantly can impact the lives of seriously ill patients. Successful applicants will become “The Norwegian Cancer Society National Group of Expertise on Lung/Pancreatic Cancer”. 2.1 ELIGIBILITY To be eligible to apply for a grant through this funding scheme, you must: • Hold a doctoral degree or other equivalent qualification • Be associated with a Norwegian university, university college, hospital, or other institution with research as part of its activities. Project managers with an active grant from the Norwegian Cancer Society are not excluded from applying. Moreover, your research project must: • Be cancer relevant and relevant to the scientific remit of the call • Be in accordance with the research strategy of your project owner institution 3
2.2 WHAT IS FUNDED You can apply for grants in the range of NOK 10 to 15 million for a project period of up to five years. The funding is awarded as a support to the group in the form of an open grant. Grants can be used to cover expenses involving, for instance, personnel, networking and running costs. In this call Ph.D positions may be included in the budget. Researcher positions For early career researchers and senior researchers with a doctoral degree and at least one completed postdoctoral period. You can apply for a researcher position for yourself and/or unnamed candidates. Postdoctoral researcher positions For unnamed candidates with a completed doctoral degree. Candidates must have successfully defended his/her thesis prior to employment. PhD positions For unnamed candidates with a completed master’s degree, or equivalent. Technical positions For laboratory technicians, study nurses, statistical personnel, or others that will offer technical assistance to the research project. Running costs To cover general costs related to the research project, including supplies, analyses, conference fees, travel, publications costs, minor equipment, etc. Can also cover project specific services on an hourly basis. Note that the Norwegian Cancer Society does not fund institutional overhead costs. The project owner institution must cover all institutional costs beyond what is offered. 3 THE APPLICATION PROCESS 3.1 APPLICATION You must submit your application online using our grants management system, ApplicationWeb.1 The application deadline is September 20, 2019 at 13.00. You may only submit one project application. The application, including uploads, must be completed in English. The application is made up of five sections in which you must input/upload all your application information.2 All uploads are mandatory unless otherwise stated. SECTION 1 – PROJECT DESCRIPTION In this section, you must upload your project description. In 10 pages or less, including figures and references, address the following: 1 We recommend using the web browser Google Chrome. 2 Uploads must not exceed the requested number of pages or 10MB. Use Arial 10 (9 for references), 2 cm margins and single spacing. Number all pages. Show the last name and initials of the project manager in a header or footer on all pages. Only PDF- files will be accepted. 4
• Current knowledge including important knowledge gap(s) within the field (based on systematic reviews or meta-analysis, if applicable) • A clear description of the project’s objectives (research questions, hypothesis, cancer relevance and potential impact in relation to the knowledge gaps) • Methodological approach (describe and give a rationale for selected methodologies) • Calculation of statistical power (projects involving laboratory animals or human subjects) • Data management plan (if applicable) • Project plan including tentative milestones • Dissemination and communications strategy • Ethical considerations (if applicable) • User involvement • Potential involvement of commercial actor(s) (if applicable) • Project infrastructure and organization. Specification of the need for each position applied for. State clearly which activities will be conducted during the project period, who will be responsible for the various work packages, and where the actual work will be conducted. If the project manager holds a main position at another institution, describe how the project is established at the prospective project owner institution, and how the supervision of possible scientific employees will be maintained. SECTION 2 – PROJECT ADMINISTRATION In this section, you must input information about your project owner institution, your project administrator and yourself, the project manager. Project Owner Institution The project owner institution is legally and economically responsible for fulfilling the terms and conditions of a Norwegian Cancer Society research grant. Norwegian universities, university colleges, hospitals and other institutions with research as part of their activities are eligible project owner institutions. The project owner institution may also be referred to as the applicant institution, prospective grantee institution, or grantee institution. Project Administrator The project administrator is an employee of the project owner institution who has the authority to commit the institution to fulfill the legal and economic obligations on the behalf of the project owner institution. The project administrator is responsible for approving the application, including the budget, prior to submission. If a grant is awarded, the administrative responsibility must be fulfilled; accepting the grant in ApplicationWeb and thereby accepting the terms and conditions described in the project contract. If applicable, prior to the transfer of funds the project administrator is responsible for submitting collaboration agreement(s) with all project partners. Project Manager The project manager is the principal investigator/scientist responsible for submitting the application in ApplicationWeb, ensuring scientific progression and project completion as well as submitting requested reports. The project manager is also referred to as the applicant. In completing this section, you must upload the following: • A four-page CV. We strongly encourage you to use the provided CV template (see Appendix). • A list of relevant publications going back seven years (excluding maternity/paternity leave, sick leave, military leave etc.). In the case of shared authorships, the authors’ names must appear in the same order as in the original article. Original scientific articles must be clearly separated from other publications such as reviews, books/parts of books, and popular scientific articles. Publications that are “in-press” may be included. For applicants who are initiating their careers as independent researchers, we strongly recommend uploading a recommendation letter. The letter should, in no more than one page, describe your scientific qualifications and potential for leading a prospective research group. 5
SECTION 3 – PROJECT PARTNERS AND PARTICIPANTS In this section, you must input information about your project partners and project participants. Project Partners Project partners are external collaborators with a central and obligated contribution to the project. For these partners we require CV and publication list, in addition to a collaboration agreement prior to the transfer of funds. Project partners can be institutions, companies and other types of enterprise, represented by a named individual associated with the organization, that will be under obligation to contribute to the project, by performing R&D activities and/or providing financing, and/or that will be granted rights to the project. The role of partners is considered to be so essential to project implementation that any changes in the composition of the partners will require the prior written approval of the Norwegian Cancer Society. The competency and participation of the partners are important factors when assessing project quality, and may play a decisive part in the decision to grant funding to the project. All partners, Norwegian as well as non-Norwegian, must be entered in the application form. You must upload a four-page CV and five-page publication list describing the last five years for all project partners. The Project Owner must enter into written collaboration agreements with all partners. This applies to both Norwegian and international partners. Should your application be granted funding, all collaboration agreements must be submitted within three months after the Norwegian Cancer Society has sent the contract to the Project Owner. Project Participants Project participants include all individuals playing an active role in the project. In this context, “active role” means that the individual will be taking part in one or more work packages, participating in the management of the project or contributing in another way to the implementation of the project. All named individuals must consent to being listed as project participants. You are to submit CVs for the key researchers participating in the project. How many CVs that makes will depend on your project. Keep in mind that the CVs are there to assist the experts when they review the application, and it is therefore important to include CVs for researchers who will contribute to the project in a significant way. On the other hand, it is not wise to include too many, as it can make it difficult for the experts who will be assessing the application to find the information that is relevant. SECTION 4 – PROJECT DURATION AND BUDGET In this section, you must enter the estimated start and end dates for your research project, a total project budget, and specify current and/or expected funding to your research project and yourself. We require a total project budget in whole NOK, rounded up to the nearest thousand. On the revenue side, enter funding from the Norwegian Cancer Society, own financing and contributions from other research funders (current and/or expected). On the expense side, enter the project’s total payroll costs for researcher positions and technical positions, as well as running costs and other costs. You must use your project owner institution’s own payroll cost rates (including salary, social security tax and social benefits). Some projects may require specific expertise that entails higher payroll costs. If this applies to your research project, you must specify why in your application. Consult with your project administrator if you have questions concerning your institution’s payroll cost rates. You may apply for part-time researcher and technical positions, but note the following: • Research positions may be 20% to 100% per year. • Ph.D positions or postdoctoral researcher positions must be 50% to 100% per year and fulfill legal requirement • Technical positions may be 20% to 100% per year. • If you apply for a part-time position, you must specify why in the project description. 6
The project administrator must approve the budget before you submit your application. An unrealistic or incomplete budget will affect the assessment of the proposal. SECTION 5 – PROJECT INFORMATION In this section, you must input a series of information about your research project. Here you provide information about the theme of your research project, and enter a Norwegian title and summary of your project. In the project summary, you must describe the background, objective, methodology, and impact of your research project. You must also describe how you will implement user involvement in your research project. You must define who the users are and how they will be involved in the project. If you believe that user involvement is not relevant to your project, you must justify why it is not relevant. You must also enter information about your research project’s clinical data. For projects that require approval from the Regional Committees for Medical and Health Research Ethics (REC) and/or the Norwegian Centre for Research Data (NSD), you may upload REC and/or NSD documentation, and/or a protocol synopsis. In this section, you must also describe the innovation potential of your research project. SECTION 6 – STATEMENT OF ACKNOWLEDGEMENT Before submitting your proposal, you must confirm that the project administrator, on behalf of the project owner institution, approves your application. 3.2 SUBMISSION When you submit your application, you will receive a confirmation email. Prior to the application deadline, you may re-open, modify, and re-submit your application as many times as you want. You will receive a confirmation email each time you re-submit your application. 3.3 EVALUATION SCIENTIFIC EVALUATION Applications are distributed, as they are received, to the peer review committee. The Norwegian Cancer Society Krafttak mot kreft call has one peer review committee, made up of appropriately qualified international experts. The peer review committee evaluates research proposals from a scientific point of view using a set of predefined assessment criteria, outlined in Table 1. Table 1. Two committee members conduct an in-depth evaluation. They give a grade for each assessment criterion, an overall grade, and write an evaluation text. The remaining committee members perform a general assessment and give an overall grade. 8
The committee members’ individual project assessments provide the basis for the peer review committee meetings, in which the committee members discuss each project proposal. The committee gives a grade for each assessment criteria 3 to 6 according to the grading scale in table 2 (an overall grade in which criteria 3 and 4 carry double weight). Criteria 7 and 8 will be given a short, written assessment. The committee writes an overall evaluation text taking all criteria into account. The peer review committee presents its list of nominations, including a ranking of projects, grades, and evaluation texts, along with suggested funding, to the board of the Norwegian Cancer Society. USER EVALUATION In line with the overall goals of the Norwegian Cancer Society, user representation is implemented as part of the assessment process to increase the impact and relevance (short -and long term) of the funded research projects. User representatives review all research proposals sent to the Norwegian Cancer Society. Two user representatives are appointed to the peer review committee. One user representative conducts an in- depth assessment, the other a general assessment. The project manager’s structured summary of his/her research proposal forms the basis for the user representatives’ assessment. The user representatives’ task is to assess whether user involvement is relevant to the project, and if so, to what degree it is adequately secured. The user representatives rank the proposals according to given criteria by using a grading scale from 1 to 7, presented in Table 3. Table 3. The user representatives’ recommendation must include an overall grade and evaluation text for each research proposal. The user representatives present their assessments to the peer review committee, with emphasis on the highest ranked proposals. The peer review committee takes the user assessments into consideration in their final ranking of proposals. In the case of two equally scored projects, the peer review committee is encouraged to prioritize projects with the higher user score. 3.4 DECISION According to the statutes of the Norwegian Cancer Society Article 3-7, the board is the Norwegian Cancer Society’s appropriating body. The board makes its final decision based on the peer review committee’s ranking lists. 9
The board can award additional funds to projects that are highly relevant to the Norwegian Cancer Society’s strategic goals, given that the peer review committee consider the projects fundable (overall grade of 4.5 or higher). 3.5 FEEDBACK You will be notified of the outcome of your application by email in December 2019. The decision email will include the individual assessment criteria grades, the overall grade, and the peer review committee’s evaluation text. Successful applicants and their project administrators will receive an email with further details regarding the terms and conditions for research grants. The project administrators are responsible for formally accepting grants. 3.6 IMPARTIALITY According to the statutes of the Norwegian Cancer Society § 10-5 regarding impartiality, the following applies. A person who has an honorary post in the Norwegian Cancer Society cannot take part in processes or decision-making that may affect himself directly, or his relatives, and the person concerned may have pronounced personal or economic interests in the case. Committee members and user representatives are obligated to report any relationship they have with applicants or fellowship candidates. Any partiality and non-participation is recorded and presented to the board of the Norwegian Cancer Society. Committee members and user representatives are automatically disqualified from evaluating research proposals if they themselves, family members, or other near relations are partners in the project or if they have a professional collaboration with the applicant or any of the key partners. Other possible grounds for declaring conflicts of interest include the following: • the committee member or user representative has published together with persons participating in the project • the committee member or user representative has professional or personal conflicts with persons participating in the project • the committee member or user representative has been supervising someone participating in the project • the committee member or user representative is a party in another case that is in direct competition with the proposal Committee members and user representatives may claim partiality on the grounds of personal reasons. This must be respected even if it is not evident that such partiality exists. Neither committee members nor user representatives are permitted to contact applicants concerning their submitted proposals during the evaluation process. In cases where a user representative declares partiality, a deputy representative is assigned. 3.7 CONFIDENTIALITY All members of the peer review committee and the user representatives must sign a confidentiality agreement. The committee members and user representatives have a legal duty neither to disclose any sensitive information acquired during the evaluation process, nor reveal the results of the evaluation process. 10

At present we see large variations in survival rates between various diagnostic groups. A priority to the Norwegian Cancer Society is to increase the research and competence on cancers with low survival rates. By this commitment, The Norwegian Cancer Society aims to stimulate to increased research activity and expertise on lung cancer and pancreatic cancer. The aim of the call is to build a “Norwegian Cancer Society National Group of Expertise” for the research on lung cancer and pancreatic cancer. The application must clarify how you will be able to contribute to improve the research field in a national perspective by using the national research expertise, promote national networking and contribute to an appropriate national work-sharing. The application needs to clarify what will make the group into a “National Group of Expertise” and how the group of expertise will continue to exist after the period of funding. It is of importance that the application explains how the group of expertise intend to make visible and credit the Norwegian Cancer Society. The Norwegian Cancer Society expects a regular dialogue with the centre in the period of funding. The Norwegian Cancer Society will award funds to establish two “National Groups of Expertise”, one for lung cancer and one for pancreatic cancer. We encourage relevant communities to collaborate. Successful applicants will become “The Norwegian Cancer Society National Group of Expertise on Lung /Pancreatic cancer”. The NOK 30 million made available through this call was raised in the 2019 Krafttak mot kreft campaign which focused on cancers with low survival rates. Eligibility Research groups dedicated to research on lung cancer or pancreatic cancer are eligible to apply for funds in this call. 12
The Groups of Expertise are encouraged to include more than one research group including scientists from different disciplines and different institutions. Definitions Project Owner Institution The project owner institution is the applicant and as such is legally and financially liable for the terms and conditions associated with any possible grant being fulfilled. The project owner institution is responsible for the project being carried out with respect to the contract. A project owner institution may be a Norwegian university, university college, research institute, healthcare enterprise and other public institutions having research as a part of their activities. 16
Project Administrator The project administrator is an employee at the project owner institution who is duly authorised to represent and obligate the institution legally and financially with respect to the Norwegian Cancer Society. The project administrator will approve the application, including the budget, before submission. The project administrator is also responsible for accepting any possible grant, entering into the project contract and collaboration agreements. Project Manager The project manager shall on behalf of the project owner institution attend to the scientific progress and execution of the project, as well as the reporting. This individual is responsible for submitting the electronic application via the Norwegian Cancer Society's ApplicationWeb. Project Partner An institution, business or enterprise that is a central, obligated participant in the project that possesses scientific, technical and/or financial resources. 4. Financial framework, project period and disbursement of payments The project ${project title} has been granted NOK ${amount} for the period ${year-month-day} to ${year-month-day}. The project start can be postponed to ${date}, for a later project start an application must be made to the Norwegian Cancer Society. The award includes VAT. and other fees that accrue during the project period such as holiday allowances, employers' contributions and pension schemes. The employer responsibilities lie with the project owner institution, which is also responsible for the disbursement of operating funds and wages. Disbursement of payments The amount granted will as a general rule be disbursed quarterly during the project period, with the first payment (double) in the second quarter. Payment is predicated upon collaboration agreements with central, committed project partners in the project having been signed and submitted (cf. Point 3. Definition of project partner). In those cases where it is relevant, a revised project description with an approved budget must also be submitted. Disbursement of payments may be halted if the Norwegian Cancer Society finds that the execution of the project deviates significantly from the contract or becomes necessary on other grounds. 5. Preconditions and obligations upon acceptance of funds from the Norwegian Cancer Society By accepting a grant through the Norwegian Cancer Society’s ApplicationWeb, the project administrator has acknowledged that the project owner institution accepts the terms and conditions that appear in this project contract as well as the content in the documents Application Guidelines Krafttak mot kreft 2019 and The Norwegian Cancer Society’s Ethical Guidelines. The project owner institution must follow applicable laws and regulations, other public regulation, ethical guidelines and recognised quality standards and norms for good research practices. The Norwegian Cancer Society makes it a precondition that all mandatory approvals exist that are required for execution of the project. The grant is given under the precondition that the project owner or project manager has not for the past 10 years received or expects to receive support from the tobacco industry. This includes enterprises, groups of companies and the like if production or sales encompasses to a significant extent on-going revenue from the production and/or sale of clearly cancer-causing substances such as tobacco. The Norwegian Cancer Society may request of the responsible institution inspection of its accounting, including complete documentation, that shows the use of the funds awarded by the Norwegian Cancer Society. 17
In the event of any possible contradiction between this project contract and the Norwegian Cancer Society’s Application Guidelines Krafttak mot kreft 2019 or collaboration agreements between the project owner institution and the Norwegian Cancer Society, this document shall take precedence. Project execution The project must be carried out with respect to the project description and any possible other agreements that have been entered into between the parties, including the payment disbursement plan. The funds can only be used for those purposes that are specified in the application. The project owner institution must ensure that everyone who performs work in the project respects the rights and obligations that follow from the contract. The Norwegian Cancer Society will not provide compensation for any possible additional costs due to leaves of absence. Handling of deviations The project owner institution must report in writing without undue delay to the Norwegian Cancer Society as regards significant deviations from the project description. The Norwegian Cancer Society will evaluate the deviation reporting and provide written feedback on the outcome. If the funds have not been used with respect to the project description and contract, then repayment may be required. Double financing If the project manager receives offers of funds for execution of all or parts of the same project, during the same space of time, then the project owner institution is obligated to notify the Norwegian Cancer Society with an explanation of how the total project costs will be distributed between the different financing sources. The Norwegian Cancer Society may require that the project owner institution decline all or parts of the Norwegian Cancer Society’s grant. Remaining funds If at the end of the project period there are leftover funds for wages or operation, then the project owner institution must enter into a dialogue with the Norwegian Cancer Society concerning any possible redisposition of such funds. The Norwegian Cancer Society may require repayment of remaining funds. 6. Projects with project partners The project owner institution is responsible for the project partners always being acquainted with the relevant parts of the contract. Any possible changes to the project partners in the project must be approved by the Norwegian Cancer Society. Collaboration agreements The project owner institution is obligated to enter into collaboration agreements that govern the mutual rights and obligations of the parties. Such collaboration agreements must exist prior to the disbursement of funds from the Norwegian Cancer Society. The project owner institution is responsible for the collaboration agreements according with the terms and conditions defined in the contract. 7. Reporting A report concerning the results achieved and deviations from the original application must be submitted by the project manager once each year. In the event of significant deviations, see point 5. 18
In the progress report, the project manager must provide information on the status of the project, employees involved in the project, scientific publications, on the execution of activities with respect to the progress plan and budget, as well as account for any possible deviations and their consequences. At the end of the project, the project manager must submit a report that summarises the results from the entire project period. The Norwegian Cancer Society must approve the final report and may, as needed, submit a request concerning a follow-up report. The final report must contain a popular science summary. If the popular science presentation is not adequate in terms of its form and content, then the Norwegian Cancer Society may request that it be reformulated. The reports will be initiated by the Norwegian Cancer Society and must be responded to via ApplicationWeb within the given deadline. An approved progress report is a precondition for further disbursements of grant payments. Lacking reporting can also have consequences for any possible new projects that are applied for with the Norwegian Cancer Society. Breaches of obligations that concern reporting may be regarded as significant breaches which give the Norwegian Cancer Society a basis for cancelling the contract. The project owner institution must inform the Norwegian Cancer Society on an on-going basis of research results connected with the project having a nature that provides commercialisation possibilities. 8. Incorporeal rights, property rights, exploitation, etc. The project owner institution and any possible project partners must secure themselves the rights for commercial exploitation of the project results, and must if necessary enter into agreements with owners, employees (including those with multiple employment relationships), subcontractors and others in order to achieve this. This securing of the rights involves no limitation in the protection of the originator's nonmaterial interests pursuant to the Norwegian Copyright Act, and poses no impediment to remuneration arrangements being able to be agreed upon for originators corresponding to those that apply for patentable employee inventions in accordance with the Norwegian Act Respecting the Right to Employees' Inventions. An overarching goal is for the research funds from the Norwegian Cancer Society to be of the best possible benefit to the cancer issue. This can occur both through commercial exploitation as well as by publication and other forms of disseminating the research results. The parties agree that 1/3 of the net income from any possible commercialisation will as a primary rule be allocated to the institute/research environment by ${responsible institution} who has developed the idea in line with ${responsible institution}'s guidelines. Revenues from commercialisable ideas that arise in extension of research funds from the Norwegian Cancer Society will in this way go towards further cancer research. Protection The project owner institution and any possible project partners must assess the need to protect project results that may be of commercial value and, when the need dictates such, protect them. If the legislation requires that the rights have to be registered in order to attain protection, then the project owner institution must ensure that this registration is undertaken. Information for the Technology Transfer Office (TTO) The Norwegian Cancer Society desires that the results of research be of benefit to the patients. The Norwegian Cancer Society thus has the right to divulge contact information and present the project 19
receiving the grant to the TTO at the associated project owner institution, in order to arrange for increased co-operation between the actors. 9. Release to the public and attribution of credit The Norwegian Cancer Society may grant Norwegian cancer researchers research funds that originate from gifts given by the Norwegian population. The donors trust that the money will be administered in a good and justifiable manner. It thus is important that the Norwegian Cancer Society be able to document how the funds are used, and thereby secure the most possible knowledge for the population on how the funds collected are being administrated. Based on this, we expect that the project owner institution and project manager will adhere to the following: - The project owner institution and project manager must jointly contribute to the Norwegian Cancer Society’s efforts being rendered visible to the general public, users and relevant professional bodies. The Norwegian Cancer Society must be clearly rendered as the financier of the research project being discussed and profiled using the Norwegian Cancer Society’s name, for example by use of the designation "Norwegian Cancer Society Research Group" or "The Norwegian Cancer Society's Group of Expertise for …", including in connection with signage, on Web sites, in reports and other informational material. This must occur in dialogue with the Norwegian Cancer Society, and the Norwegian Cancer Society will be of assistance in procuring the requisite material. - The Norwegian Cancer Society must be credited as the financing source in all publications that are directly associated with the project. - The Norwegian Cancer Society’s logo must be used in presentations, posters, publications, on Web pages, annual reports, course materials, and the like. - When the project owner institution or project manager makes statements about the project in the media, the Norwegian Cancer Society must be credited as the financing source. - The project owner institution and project manager must with no remuneration and as much as possible contribute to the dissemination of research results. The Norwegian Cancer Society has the right to release to the public the name of the project owner institution, project manager, project title, project duration, project summary, popular science explanation and its financial contribution. If the popular science presentation that was submitted with the application is not adequate in terms of its form and content, then the Norwegian Cancer Society may request that it be reformulated. Unless there are special reasons that argue against it, the project owner institution must ensure that the project results are published and disseminated as quickly as possible. Research-generated data must be deemed to be publicly available if there are no special reasons that argue against it or contractual terms and conditions or governmental rules exist that prevent this. The Norwegian Cancer Society possesses the right to use the data in its work unless there are special reasons that dictate to the contrary. What is meant by special reasons is protection of the project owner institution's incorporeal rights, the risk of being plagiarised, breaches of non-disclosure obligations, the risk of damage that such release to the public may cause to the project owner institution's enterprise, as well as other reasons that make the requirement for release to the public unreasonable in proportion to the interests of the project owner institution. 10. Indemnification and immunity from liability The project owner institution bears the responsibility for the execution of the project not infringing upon the rights of third parties, including third-party copyrights and other incorporeal rights, or in some other manner that could bring about claims from third parties. 20
The project owner institution must indemnify the Norwegian Cancer Society against all claims that might arise in connection with the execution of the project, including claims that follow from infringements of incorporeal rights. The Norwegian Cancer Society is not legally or financially liable for damage or losses due to, among other things, errors in or untrained use of equipment, methods or programs that are associated with the project. 11. Force majeure Each of the parties shall without undue delay notify the other parties if a force majeure situation prevents the party concerned from fulfilling its obligations under the contract. None of the parties are liable for a lack of adherence to their obligations under the contract in consequence of force majeure. If force majeure endangers the project itself, then the parties must meet in order to negotiate necessary adjustments to the project. If the parties do not reach agreement on such adjustments, then the Norwegian Cancer Society may halt disbursements to the project. 12. Duration and cessation of the contract The contract will cease without notification when the project has ended and its final report has been submitted and approved, unless the contract period ceases earlier. Ending of the contract by agreement The parties may by written agreement wind up the contract before expiry of the project period. Cancellation Cancellation of the contract must occur in writing and must be justified. The Norwegian Cancer Society may cancel the contract with immediate effect if the project owner institution has significantly breached its obligations. A significant breach is deemed, among other things, to comprise: - the existence of significant deviations in relation to the progress plan or other conditions governed in the contract - the project owner institution breaking its obligations for reporting, cf. point 7. - the grants disbursed being used in violation of the contract or what was agreed between the parties - the project owner institution conducting activities that are incompatible with the applicable legislation or the Norwegian Cancer Society’s goals and guidelines, including ethical guidelines - the project owner institution not desiring to or not being able to complete the project - central preconditions for the contractual relationship being abandoned, including the Norwegian Cancer Society not having the requisite funds placed at its disposal, changes being made in governmental regulations or other unforeseen circumstances arising that are of essential significance to the execution of the project or the Norwegian Cancer Society’s ability to contribute to it The project owner institution may cancel the contract with immediate effect if the Norwegian Cancer Society has significantly breached its obligations. If the Norwegian Cancer Society cancels the contract due to a significant breach at the project owner institution, then the Norwegian Cancer Society may require repayment of disbursed grants, with the addition of late payment interest with respect to the applicable law concerning interest on late payments, from the point in time of the cancellation. 21
