Approve “Outreach and Engagement” grant agreement template to be used for selected community- and faith-based organizations to perform outreach and engagement services as outlined in the agreement for the Emergency Rental Assistance Program (ERAP); and B. Delegate Authority to the Director of the Community Development Agency or designee to execute Outreach and Engagement grant agreements in amounts up to $6,000 with the organizations listed in the Attached Exhibit A; and C. Authorize Phase 1 payments of up to $131,500 to the organizations on Exhibit A with funds from the Administration portion of the Federal Emergency Rental Assistance Grant; and Authorize the Auditor-Controller to make the related budget adjustments. DISCUSSION/SUMMARY: On January 12, 2021 (Item No. 25.1), your Board authorized the County Administrator’s Office to apply for up to $29,648,131 from the U.S. Department of the Treasury (Treasury) for ERAP for low-income tenants who are behind on their rent due to COVID-19. The funds come from the Consolidated Appropriations Act, 2021, signed into law on December 27, 2020. Within Alameda County, the cities of Fremont and Oakland and the County each received an allocation of funding for emergency rental assistance. Subsequently, the State of California, which also received funding, further allocated funding to the County and the two cities to assist in bringing tenants current with their rents. The Alameda County ERAP covers all communities in the County except the cities of Fremont and Oakland. The first phase of the ERAP program, funded by the Treasury money, commenced on March 17 and will run through early May. Phase 2 will be funded by an additional $32 million from the State and will begin as Phase 1 ends. Your Board authorized application for the State funding on April 20th (Item No. 24).
Board of Supervisors May 4, 2021 Page 2 In the federal grant, 90% must be spent on direct rental assistance ($26,683,918) and up to 10% may be used for administration ($2,964,813). The administration funding will be used to create the web-based application portal, market the program, conduct community outreach and engagement, perform landlord engagement, fund 211 for a call center, review applications, approve applications, cut checks, and provide assistance to those who need help. For more detail on the use of the 10% administration funding, please see Exhibit C. HCD issued a Request for Information (RFI) to secure organizations to serve as ERAP Outreach Ambassadors for the Alameda County ERAP. The application was released on March 15 and was due on March 29. Forty-five organizations applied to serve as Outreach Ambassadors. All 45 organizations will be funded under either Phase 1 or Phase 2. Actions related to Phase 2 will return to this Board at an upcoming meeting. The template agreement before your Board today will govern the relationship between the County and the outreach and engagement organizations for specific work each organization will agree to perform in exchange for small stipends. These payments will come from a portion of the funds available for ERAP administration. ERAP Outreach Ambassadors will promote, educate, and direct outreach to targeted constituencies to increase awareness and participation in the Alameda County ERAP. This could include, but is not necessarily limited to, hosting information events, adopting a block to distribute ERAP information, canvassing, and distributing ERAP information through electronic and social media to constituents. Each Outreach Ambassador will be required to exhibit their engagements (social media posts, e- newsletters, text blasts, and virtual information session attendance) to receive payment and will be required to attend an orientation training. Given the vital importance of ensuring that the ERAP funds are utilized throughout Alameda County to preserve housing stability for the County’s most vulnerable populations, staff utilized the Urban Institute’s Emergency Rental Assistance Priority Index* to identify the renters who are at risk of experiencing housing instability and homelessness. This Index estimates 33 high need census tracks throughout the county. Exhibit D is a summary of the Index and map of the county. While the concentration of the need for rental assistance exists in Mid-County, there are pockets of need in each region. To ensure comprehensive outreach and engagement, the 45 organizations were analyzed to determine what demographic populations they serve and align the highest needs areas to the organizations that serve those populations for the first phase of outreach and engagement (See Exhibit A). In the second phase of outreach and engagement, funded by the State ERAP program, the rest of the applicants under the competitive RFI that was released are slated for funding. Under a separate contract and board letter approved by your Board on May 4 (Item No. 26), a marketing contract with Full Court Press to develop materials, advertising, and promotion through ethnic media sources will help get information about the program out more broadly throughout Alameda County beginning in Phase 2.
Board of Supervisors 0D\, 2021 Page 3 SELECTION CRITERIA AND PROCESS: HCD issued an RFI to secure organizations to serve as ERAP Outreach Ambassadors for the Alameda County ERAP. The intention of the RFI was to generate a pool of community- and faith-based organizations with a demonstrated ability to conduct outreach or provide direct application assistance to their lower-income constituents who have been economically impacted by COVID-19. The RFI inquired about the specific cities and neighborhoods in which the organization’s clients live in order to ensure such outreach resources will be directed towards the areas of greatest need. Forty-five organizations applied to serve as Outreach Ambassadors. One of these organizations was on the County’s Small, Local and Emerging Business list. All of the organizations are rest of the local to Alameda County. The RFI was due on March 29. Applicants were evaluated on the following criteria: constituency alignment, experience and track record, proposed outreach activities, capacity, and achievable timeline. All applicants met the threshold criteria and will be funded in either Phase 1 (Exhibit A) or Phase 2 (Exhibit B) of the outreach program. Organizations selected for Phase 1 are those serving tenants in higher needs areas, as determined by the Emergency Rental Assistance Index, detailed on Exhibit D. FINANCING: Funding for these grant agreements comes entirely from the County’s allocation of Federal Emergency Rental Assistance Program funds. There is no increase in Net County Cost as a result of this action. Board of Supervisors May 4, 2021 Page 7 Exhibit D Urban Institute’s Geographic Analysis of Emergency Rental Assistance Need Alameda County seeks to ensure that low-income renter populations who have been negatively impacted by COVID-19 and unable to pay their rent have access to this important funding source. The Urban Institute’s data combines the following three data sets: Housing Instability Risk Subindex (which ranks tracts based upon income level, unemployment, renter households, rent burden, and overcrowded housing), COVID-19 Impact Subindex (which ranks tracts by share of the population without health insurance and low-income jobs lost to COVID-19) and Equity Subindex (which ranks tracts based upon share of people of color, of immigrants, of extremely low–income renter households, and of households receiving public assistance). As clearly depicted in the map below, the greatest area of need (outside of Oakland and Fremont) is Mid- County, in the Hayward and Unincorporated Areas. According Urban Institute’s Emergency Rental Assistance Priority Index, there are 33 high need census tracts in Alameda County with approximately 11,000 extremely low-income tenant households. These 33 tracks ranked 70% or higher on the Emergency Rental Assistance Priority Index and thus were the areas prioritized for Phase 1 Outreach. While the concentration of the need for rental assistance exists in Mid-County, there are pockets of need in each region. In order to ensure comprehensive outreach and engagement, the 45 organizations were analyzed to determine what demographic populations they serve and aligning the highest needs areas to the organizations that serve those populations. OUTREACH AMBASSADOR GRANT AGREEMENT The County of Alameda (“County”) and _____________________ (“Organization”), hereby agree as follows: 1. GENERAL TERMS, CONDITIONS, AND UNDERSTANDINGS A. County shall provide a grant to Organization in the amount of $ _________ (________ thousand dollars), in exchange for Organization’s services, described below. B. Organization shall: 1. Use the Grant Award only as specified by the terms, conditions, and understandings of this Agreement and as specified in the approved activities list attached hereto as Attachment A and incorporated herein by this reference. 2. Maintain records to show and account for the uses of the Grant funds. 4. Allow HCD access to records to verify Grant Award expenditures and activities. 5. PUBLICITY The Organization shall include mention of the sponsorship of the ERAP Outreach Ambassadors Program by the County in any press releases, news conferences, and other media contacts concerning the Program. All materials developed or published electronically or otherwise by the Organization in connection with the Program, including electronic emails, social media posts, brochures, flyers, announcements, or other materials, shall mention this sponsorship and reference the official name of the Program as “AC Housing Secure”. Logos for Alameda County Community Development Agency, Alameda County HCD, and Alameda County Housing Secure suitable for reproduction will be electronically provided to your organization at the Orientation Session in early May. 3. MANDATORY ORIENTATION SESSION Two virtual orientation sessions for Outreach Ambassador Organizations will be offered by HCD during the first two weeks of May 2021. Details on the meeting dates and times will be provided at a later date. Organization shall attend one of the sessions, as it will provide an overview of the ERAP, a review of Outreach Ambassador Organization expectations, and a brief orientation to the Alameda County Housing Secure website (https://www.ac-housingsecure.org/) Electronic versions of marketing materials and resources and County logos to use in publicity/outreach efforts will be provided as follow-up to the orientation session. INVOICING A. Organizations shall comply with the following invoicing terms and conditions: 1. Organizations may submit for payment of the Grant Award only upon the conclusion of all activities associated with the organization’s approved proposal as found in Attachment A. 2. Payment shall not exceed the total amount provided through this Grant Award. 3. Organizations may only submit for one (1) lump sum payment of the Grant Award. 4. Invoice submittal may be made after activities have been completed; however, in no case may organization request for payment later than November 30, 2021. County has no obligation to pay any amount to Organization if the invoice is received after November 30, 2021. 5. Due to the ongoing COVID-19 pandemic, the County will accept electronic invoice submittals and electronic signatures (e.g., DocuSign, etc.) 6. The County will use its best efforts to make payment within thirty (30) calendar days following receipt, review and approval of invoice and only upon satisfactory performance of activities under the Grant Award. 7. Payment shall only be issued to the organization that was awarded the Grant Award. 8. Request for payment must include the following documents: a. An invoice including the total requested Grant Award amount and the organization’s mailing address b. Completed Checklist on Attachment A documenting activities completed under Grant Award. c. Copies of Supporting Documentation as required on Checklist on Attachment A. d. A signed, current IRS W-9 form is required to be provided before invoice will be processed. Organization provided W-9 through RFI submittal. HCD will notify the organization if an updated W-9 is required. 5. RIGHT TO MODIFY OR REVOKE: The County reserves the right to discontinue, modify or withhold any payments to be made under this Grant Award or to require a total or partial refund of any Grant Award Funds if, in the County’s sole discretion, such action is necessary: (1) because organization has not fully complied with the terms and conditions of the Grant Agreement; (2) to protect the purpose and objectives of the Grant Award and/or the Alameda County ERAP; or (3) to comply with the requirements of any law or regulation applicable to the organization, Alameda County, or this Grant Award. If Outreach Ambassadors do not fulfill outreach requirements based upon their funding level described in their Scope of Work and corresponding checklist, they will receive payments for the level below their contracted amount. Attachment B - Additional Terms and Conditions 1. Independent Contractor. Organization is an independent contractor, not an employee of County. No relationship of employer and employee is created by this Agreement. Organization is not entitled to County employment wages or benefits of any kind. County shall not be liable for any acts or omissions by Contractor nor for any obligations or liabilities incurred by Contractor. 2. Maximum Payment. The maximum compensation payable to Organization pursuant to this Agreement and for any outreach services contemplated by this agreement is the amount listed on Page 1 of the Agreement (Paragraph 1.A.) The County shall not be responsible for compensating the Organization for any amounts in excess of the Grant Award. 3. Cancellation. Either the County or the Organization may cancel this Grant Award at any time upon giving the other party fifteen (15) calendar days' written notice of such cancellation. In the event of cancellation, the Organization shall forfeit any right to the Grant Award or any portion of the award. 4. No assignment/transfer of this contract. The Organization shall not assign this Grant Award, or any part thereof, or any right of the Organization hereunder without the prior written consent by the County’s. 5. Indemnification. To the fullest extent permitted by law, Contractor shall hold harmless, defend and indemnify the County, its Board of Supervisors, employees and agents from and against any and all claims, losses, damages, liabilities and expenses, including but not limited to attorneys’ fees, arising out of or resulting from the performance of services under this Agreement, provided that any such claim, loss, damage, liability or expense is attributable to bodily injury, sickness, disease, death or to injury to or destruction of property, including the loss therefrom, or to any violation of federal, state or municipal law or regulation, which arises out of or is any way connected with the performance of this agreement (collectively “Liabilities”) except where such Liabilities are caused solely by the negligence or willful misconduct of any indemnitee. The County may participate in the defense of any such claim without relieving Contractor of any obligation hereunder. The obligations of this indemnity shall be for the full amount of all damage to County, including defense costs, and shall not be limited by any insurance limits. 6. Compliance with laws. The Organization agrees to observe all applicable laws including, but not limited to, anti-discrimination and drug-free workplace requirements. No person shall, on the grounds of race, creed, color, disability, sex, sexual orientation, national origin, age, religion, Vietnam era Veteran’s status, political affiliation, or any other non-merit factor, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under this Agreement. The Contractor covenants that it presently has no interest, and shall not have any interest, direct or indirect, which would conflict in any manner with the performance of services required under this Agreement. 7. Maintain Records. Organization shall maintain records relevant to this Agreement for at least 5 years. The Contractor shall make available to the County, its authorized agents, officers, or employees, for examination any and all ledgers, books of accounts, invoices, vouchers, cancelled checks, and other records or documents evidencing or relating to the expenditures and disbursements charged to the County, and shall furnish to the County, its authorized agents, officers or employees such other evidence or information as the County may require with regard to any such expenditure or disbursement charged by the Contractor. 8. Entire agreement; modifications. This Agreement, including all attachments, constitutes the entire agreement between County and Organization relating to the subject matter of this Agreement, and supersedes all prior written or oral discussions or agreements between the parties. Attachment C Insurance Requirements During the Term of the Grant Agreement (May 18, 2021 through November 30, 2021), and any extension or modification thereof, the Organization shall keep in effect insurance policies meeting the insurance requirements specified in the insurance provisions which are attached hereto and incorporated herein by this reference. Contractor shall provide Workers' Compensation insurance, as applicable, at Contractor's own cost and expense and further, neither the Contractor nor its carrier shall be entitled to recover from County any costs, settlements, or expenses of Workers' Compensation claims arising out of this Agreement.
