Product/Vendor Eligibility • All vendors are subject to market committee approval for all markets. • Market management reserves the right to complete farm/establishment inspections to verify production methods. • All non-food item vendor applications require photos and descriptions. Please include photos of your products with this application or email to shey@rogerslowell.com. Applications without photos will not be considered. • Market management reserves the right to turn down application for membership. If membership is denied, any payments will be returned. • Vendors must review market guidelines and adhere to all rules and expectations as listed. Any questions or requests for exceptions need to be discussed with market management before the season begins. Guidelines Farmers Market Highlights • Saturdays 8am to 1pm, May 1st through October 31st on 1st Street in Historic Downtown Rogers. • Traditional farmers market with assigned vendor spots • Vendors can pull in their spot and sell from the back of their trucks, or set up booths. • Vendors must bring all equipment needed. Governance • The DTR Market is operated by Downtown Rogers Incorporated, a 501c3 nonprofit providing community events • Downtown Rogers Inc. is an entity of the Rogers Lowell Area Chamber of Commerce • There will be no DTR Inc. staff on site, but vendors can call XXX-XXX-XXXX for all non-threatening emergencies. • In the event of a life or safety threatening emergency, vendors are to call 479-621-1172 (Rogers Police Non-Emergency Line) or 911 and then call the DTR Inc. number above. Market Eligibility and Expectations Applications • All vendors must submit an application, obtain approval, and make payment before selling. Each business or entity must submit an individual application. o All vendors are subject to approval by the market committee and are allowed to participate in the market at the discretion of Downtown Rogers Inc. (DTR). In the best interest of the market, DTR may revoke this privilege at any time. • Vendors will be placed into the category that best represents their primary product(s). Items brought to the market throughout the season should reflect that primary category. • Vendors are subject to farm/site visits for verification of production methods and product origin. These visits will be scheduled with market management upon acceptance to market. • Nutrition Programs: Vendors are responsible for filling out applications and displaying all signage for participating programs. Products • Consumable Products: Products grown, raised, or produced through agricultural activity, such as fruits, vegetables, plants, flowers, seeds, or animal products; baked goods, prepared foods, and items made primarily from farm raised/collected items. o Vendors are responsible for meeting expectations of the Arkansas Department of Health and Cottage Food Laws. Any questions or concerns should be directed to the health department. All necessary permits or licenses should be obtained before the market season begins and submitted with application. o Any certifications and licenses regarding food quality and practices, such as USDA Organic or Certified Naturally Grown, should be submitted with application and displayed at vendor booth. No claims are to be made to “natural” or “organic” status on signage, packaging, or verbally without certification. • Non-Consumable Products: Products that are handmade items such as soaps, lotions, wood working, artwork, knit items, jewelry, wreaths, etc. Use of local materials is strongly encouraged. • Priority is given to local/regional products and all vendors are required to disclose product origin. • All crafts sold at the market must be original in nature; meaning component materials are sufficiently altered from their original state to demonstrate craftsmanship. • Items not produced by the vendor, their family, or employees must have written approval for sale from market management. The producer of the item must be clearly displayed and labeled at the point of sale. Selling and Spaces • Vendors must display vendor names and prices clearly. • Produce vendors are expected to communicate product availability, to the best of their knowledge, prior to season start. • Vendor spaces are assigned unless otherwise arranged by market management to accommodate needs. • Electrical and any other utility connection requests must be made in advanced and may be written onto application. No guarantees will be made and priority is given to vendors requiring electricity for food safety. • Vendors are highly encouraged, for their own sake, to make booth space appealing to shoppers as much as possible. • The market is outdoors at the Railyard Park Plaza starting at the intersection of 1st and Walnut and running south. • Consumption of alcoholic beverages by vendors during market hours is prohibited. Attendance • All vendors are expected to arrive and be ready to go by start of market at 8am. • Vendors may and are encouraged to schedule planned absences in advanced (i.e. vacations). • Vendors must notify market management by phone or email before market opening if they will be absent. Sustainable Initiatives • All vendors are expected to reconsider packaging and materials used and move away from plastic, as appropriate. Assistance and resources are available; please discuss with market management. • All vendors are encouraged to use compostable items for sampling. If using non-compostable items, vendors must collect waste at their booth and dispose of properly. • Please discuss any questions, concerns, and opportunities with the market manager. Daily Vendors • Daily vendors are required to submit an application at least 2 weeks prior to the market day applied for and return signed guidelines + payment prior to participation. • Daily vendors must be selling products that fit the guidelines as stated above or offer an engaging experience for market goers and be relevant to the market and community. Compliance • All complaints must be submitted in writing to the Market Manager. • All complaints will be reviewed and addressed as deemed appropriate by the Market Manager and DTR Inc. • All participants are expected to uphold stated expectations and represent themselves, the market, DTR Inc., and community in an appropriate manner that fosters community pride. • Vendors are expected to treat each other with respect. Any complaints or issues with another vendor should be discussed with market management. • Distribution of political and religious materials, campaigning, petitions, and promotions of any kind are prohibited. • Failure to comply with guidelines will be addressed with a written warning. Continued offenses may warrant dismissal from the market without refund of any and all payments made to DTR Inc. or affiliated organizations. DTR Market | downtownrogersinc.org | 479-936-5487
Fees and Payments • All vendor payments are due prior to participation in the market. • All vendors, including daily, are asked to share weekly or monthly sales totals for data tracking. • Refunds are not given for daily or season fees. • Vendors are responsible for registering with the Arkansas Department of Finance and Administration and paying all eligible taxes. DTR Inc. holds no responsibility for guidance or compliance of any sales reporting and taxes owed by vendors. As a Vendor at the DTR Market, I agree to all stated guidelines, to conduct myself/my business ethically to contribute to the growth of the market, and hereby indemnify and hold harmless the DTR Market, DTR Inc., and Rogers-Lowell Area Chamber of Commerce from any and all losses, claims, liabilities, obligations, costs and expenses, arising from or in connection with Vendor’s participation in the DTR Market and use of the Premises including, without limitation, damage or personal injury to Vendor, Vendor employees, or any other person or property from any cause.
