City of San Gabriel STAFF REPORT DATE: September 13, 2021 TO: Planning Commission FROM: Samantha Tewasart, Acting Community Development Director/Planning Manager Anthony Alvarado, Associate Planner SUBJECT: 227 West Valley Boulevard Unit 108A Planning Case No. CUP21-004 (Conditional Use Permit) Applicant: Allen Chen SUMMARY This is an application for a Conditional Use Permit (CUP) to allow the on-site sale and consumption of beer and wine (Type 41 ABC License) in conjunction with food service at an existing restaurant “Killer Noodle” located at 227 West Valley Boulevard Unit 108A. The property is located in the C-CT (Commercial Center) zone within the Valley Boulevard Specific Plan and has a General Plan land use designation of Commercial Specific Plan. Staff recommends that the Planning Commission ADOPT a Resolution APPROVING Planning Case Number CUP21-004 at 227 West Valley Boulevard Unit 108A, subject to the recommended Resolution with conditions of approval (Attachment A). BACKGROUND The project site is in the Hilton Plaza located on the northeast corner of Valley Boulevard and Abbot Avenue. Subject Property The 54,368 square-foot shopping plaza was constructed in 2003. Killer Noodle restaurant applied for a business license in October of 2019 for the 1,480 square foot restaurant space. The proposed project would allow the existing restaurant to sell beer and wine in conjunction with the sale of food, which requires a CUP per San Gabriel Municipal Code (SGMC) Section 153.151.

A copy of the menu has been provided as Attachment C. Along with the food options, the business is also proposing to include beer and wine for their customers to consume with their meals. The applicant believes that the addition of beer and wine would complement the food options and add to the customer appeal for the business. The restaurant is proposing to operate from 11:00 a.m. to 10:00 pm on Monday through Sunday. 2
COMPATIBILITY OF USES The project site is located on the northeast corner of West Valley Boulevard and Abbot Avenue within the Hilton Plaza. The commercial plaza is located within an area that contains a variety of commercial retail, medical offices, professional offices, and restaurant uses. SGMC Section 153.162(A)(3)(a) states that in determining whether to approve a CUP application for alcoholic beverage sales, the Planning Commission shall consider the nature and use of real property within 500 feet of the use. The location of similar nearby uses, residences, parks, schools, and churches shall be identified. There are parks and schools within a mile radius of the project site. Marshall Park is within a 0.5 miles walking distance and Vincent Lugo Park is within a 0.8 miles walking distance. Gabrielino High School is within a 0.9 miles walking distance while Dewey Elementary School is within 0.7 miles and McKinley Elementary is within 0.3 miles. Conditions of approval have been added to prevent loitering, prohibit the sale and consumption of alcohol, restrict late night operating hours, and require that at least two employees remain on-site at all times. The proposed addition of beer and wine sales is incidental and would only be served with food. Based on analysis of the surrounding uses, staff believes that the proposed sale of beer and wine is compatible with neighboring businesses and uses. Staff has included conditions related to security and hours of operation to ensure compatibility with neighboring land uses. SECURITY The CUP application, plans, and related materials were reviewed by the San Gabriel Police Department. To ensure the safety of the restaurant business, its patrons, the neighborhood, and the general public, the Police Department is requiring “Killer Noodle” to comply with the following conditions of approval: The business shall immediately notify the Police Department of any crimes that occur inside the location, or in any areas under the control of the management, or to any patrons of the location, or at the request of any patrons of the location. (Condition of Approval #14) The Police Department will require the installation of a video surveillance system and centrally monitored alarm system. (Condition of Approval #15 and 16) GENERAL PLAN CONSISTENCY The General Plan land use designation for the subject site is Commercial Specific Plan. The proposed addition of beer and wine to an existing restaurant use supports the following goals of the General Plan: The project meets the following goal of the 2004 General Plan: Economic Goal 4.1 – Create a vibrant business community. o “Killer Noodle” offers both a Japanese and Sichuan fusion noodle menu that would benefit with the addition of beer and wine to be served complementary to the food experience. 3
VALLEY BOULEVARD SPECIFIC PLAN CONSISTENCY The VBSP has Sustainable Land Use Policies that are intended to help promote sustainable land use development on all commercial centers located along Valley Boulevard. They also address the desired land use objectives to be achieved within the commercial centers. This proposed project is consistent with the following policies: 2.1 Sustain and enhance commercial centers that provide for the needs of local residents and visitors from the region; 2.3 Accommodate the development of retail, service, office, entertainment, restaurant, cultural, and similar community-serving uses; PUBLIC NOTICING On September 2, 2021, a notice regarding this project was sent to properties within a 500-foot radius of this project site. The meeting agenda was also posted at the post office, in front of City Hall, and at the post office. Additionally, a notice was published in the September 2, 2021 issue of the San Gabriel Sun. The meeting agenda was posted online, in front of City Hall, the San Gabriel Post Office, and the San Gabriel Public Library. ENVIRONMENTAL REVIEW This project is exempt from the requirements of the California Environmental Quality Act, per Guidelines Section 15301, Class 1 (Existing Facilities). RECOMMENDATION Staff recommends that the Planning Commission: ADOPT A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN GABRIEL, CALIFORNIA, APPROVING PLANNING CASE NUMBER CUP21-004 FOR A CONDITIONAL USE PERMIT TO ALLOW THE ON-SITE SALE AND CONSUMPTION OF BEER AND WINE (TYPE 41 ABC LICENSE) IN CONJUNCTION WITH FOOD SERVICE AT 227 WEST VALLEY BOULEVARD UNIT 108A, SUBJECT TO THE RECOMMENDED CONDITIONS OF APPROVAL. ATTACHMENT A RESOLUTION NO. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN GABRIEL, CALIFORNIA, APPROVING PLANNING CASE NUMBER CUP21-004 FOR A CONDITIONAL USE PERMIT TO ALLOW THE ON-SITE SALE AND CONSUMPTION OF BEER AND WINE (TYPE 41 LICENSE) IN CONJUNCTION WITH FOOD SERVICE AT 227 WEST VALLEY BOULEVARD UNIT 108A, SUBJECT TO THE CONDITIONS OF APPROVAL. WHEREAS, On May 3, 2021, the applicant submitted an application for a Conditional Use Permit to allow the on-site sale and consumption of beer and wine (Type 41 ABC License) in conjunction with food service at 227 West Valley Boulevard Unit 108A; and WHEREAS, the project site is zoned C-CT (Commercial Center) within the Valley Boulevard Specific Plan and has a General Plan land use designation of Commercial Specific Plan; and WHEREAS, the subject property is bounded by residential uses to the north, the Hilton Hotel to the east, the Swiss Plaza to the south, and Mega Bank Office Building to the west; and WHEREAS, on September 13, 2021, the Planning Commission held a duly noticed public hearing, at which time it considered all material and evidence, whether written or oral, after which it voted to approve the project; and NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of San Gabriel as follows: SECTION 1. CONDITIONAL USE PERMIT. The Planning Commission hereby approves the Conditional Use Permit (CUP) to allow the on-site sale and consumption of beer and wine (Type 41 ABC License) in conjunction with food service at an existing restaurant “Killer Noodle” at 227 West Valley Boulevard Unit 108A based on the following findings: 1. That the proposed use is consistent with the General Plan: The proposed addition of beer and wine to a restaurant is permitted in the C-CT zone, subject to approval of a Conditional Use Permit. It is also consistent with the General Plan land use designation, where all forms of retail and service, including restaurants, are allowed. The sale of beer and wine will be incidental to the primary use, which is restaurant. 2. That the site is adequate in size, shape, topography, and location to accommodate the proposed use: The size, shape, and topography of the site are adequate to accommodate the service of the restaurant with the addition of beer and wine. The proposed use will not affect the floor area of the existing building. Furthermore, the addition of beer and wine sales will not have an impact on the parking and circulation at this site. 3. That there will be adequate street access to and from the site for the proposed use, and the proposed use will not create hazardous traffic conditions: 1
ATTACHMENT A The proposed addition of beer and wine to Killer Noodle restaurant will not impede street access to and from the site. Since the space was approved for restaurant use, the proposed project would not result in the creation of hazardous traffic conditions. 4. That the proposed use is compatible with surrounding properties and uses: There are parks and schools within a mile radius of the project site. Marshall Park is within a 0.5 miles walking distance and Vincent Lugo Park is within a 0.8 miles walking distance. Gabrielino High School is within a 0.9 miles walking distance while Dewey Elementary School is within 0.7 miles and McKinley Elementary is within 0.3 miles. However, as conditioned, the proposed addition of beer and wine will not have a detrimental effect on the surrounding properties and will be compatible with the commercial and residential uses occurring near the existing restaurant space. The addition of beer and wine to a restaurant can be determined as a public convenience, not a nuisance. 5. That the proposed use is not detrimental to the public health, safety, or general welfare: With the recommended conditions of approval, the proposed addition of beer and wine to the restaurant use would not be detrimental to the public health, safety, or general welfare. Staff has added conditions of approval to ensure the proposed project would not be detrimental to the surrounding area. SECTION 2. CEQA. This project is exempt from California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines § 15301, Class 1 (Existing Facilities). SECTION 3. EFFECTIVE DATE. This Resolution shall become effective at the end of the ten (10) business day appeal period, unless appealed. SECTION 4. MAILING OF RESOLUTION. The Planning Commission Secretary is hereby directed to mail, with a proof of service, a signed copy of this Resolution to the applicant. 2

CUP21-004 PROJECT DESCRIPTION: CONDITIONAL USE PERMIT FOR BEER AND WINE IN CONJUNCTION WITH FOOD SERVICE AT AN EXISTING RESTAURANT (KILLER NOODLE) APPLICANT: ALLEN CHEN The following conditions must be made a part of the approval of the project, and must be complied with in their entirety and copied on the revised sets of plans for construction plan check: General Notices 1. Right to Appeal: You have the right to appeal this decision within ten (10) business days by filing a letter of appeal with the City Clerk’s office and paying the appeal fee of $565, as well as the advertising fee ($400) and posting fee ($150). This appeal period expires on Monday, September 27, 2021 at 5:00 PM after which an appeal may not be filed. 2. Conditions are Binding: Once the appeal period has expired, all conditions of approval are final. No approval must be valid until the applicant has signed the affidavit at the bottom of this document stating that (he/she) has received, read, understands, and accepts the conditions of approval. All conditions are binding, and the City retains continuing jurisdiction to ensure that all requirements of an approved permit are met. 3. Follow the Law: The City’s approval of your application does not relieve you from compliance with other Federal, State, or City requirements. Failure to comply with any of the above conditions shall result in the review and possible revocation of the CUP by the Planning Commission. 4. All Improvements Must Be Finished to Occupy: No occupancy permit can be granted, nor any building permit “finaled,” until all improvements required by this approval have been properly constructed, inspected, and approved. 5. Changes Must Be Approved: Any revisions to an approved application must be resubmitted to the Community Development Department for review and approval. 6. Expiration: The Conditional Use shall terminate when discontinued for 180 consecutive days as documented by the Community Development Department. 7. Indemnification: The applicant shall defend, indemnify, and hold harmless the City, its agents, officials, and employees from any claim, action, or proceedings against the City or its agents, officials or employees that is brought to attack, set aside, void, or annul an 1
EXHIBIT 1 approval of the City issued as related to the project for which the applicant is applying. The City shall promptly notify the applicant of any such claim, action, or proceeding and the City shall cooperate in the defense. In the event of a disagreement between the City and applicant over litigation issues, the City shall have the authority to make dispositive litigation decisions, including, without limitation, settlement. Planning Division Conditions (626) 308-2806 8. Use Permit Within 6 Months: Approval of a conditional use permit shall be used within six months from the effective date of approval. The effective date of approval occurs 10 business days after your application has been acted on, assuming no appeals are filed. 9. Hours of Operation: The business shall be allowed to be open from 11:00 a.m. - 10:00 p.m., Monday through Sunday. Should the applicant wish to expand upon these hours of operation at a later date, approval by the Planning Commission may be required. 10. Neighborly Conduct: Management shall take appropriate measures to ensure that patrons and employees do not disturb neighbors, including noise levels, trash and debris, etc. 11. Additional Conditions: The Planning Division reserves the right to add additional conditions of approval based on subsequent submittals. 12. Complementary to Food: There shall be no sale of beer or wine for consumption unless said items are served in conjunction with food. Police Department Conditions (626) 308-2846 13. Security Ordinance: Applicant shall comply with the City of San Gabriel’s security ordinance (SGMC Sec. 150.210 – 150.223). 14. Cooperation with Law Enforcement: The management shall immediately notify the San Gabriel Police Department of any crimes that occur inside the location, or in any areas under the control of the management, or to any patrons of the location, or at the request of any patrons of the location. The managers or employees of the location shall fully cooperate with any law enforcement agency that is conducting any lawful investigation in regard to that location. 15. Alarm System: An alarm system shall be installed. 16. Video Surveillance: A video surveillance system shall be installed and meet the following requirements: a. All video surveillance systems shall be properly maintained in good working order at all times. b. All systems shall have the ability to record all cameras for later playback in the event of an incident at the location. 2
EXHIBIT 1 c. Recording media shall be periodically replaced so that image deterioration does not occur due to excessively worn media. d. The recording media shall be stored a minimum of 10 days before destruction or reuse and must be made available to law enforcement agencies for law enforcement purposes upon request. e. The system used shall be capable of providing an image sufficient to identify faces under all lighting conditions at the location. f. Minimum Coverage/Camera Locations shall cover the following: - With clear view of cash register. - Interior entrance and exit. 17. Visibility: Visibility into the interior of the premises shall not be blocked by window tinting, opaque coverings of any nature that does not allow a clear and unobstructed view into the interior of the business by passing vehicles and pedestrians during the hours the business is in operation; or by painted signs covering more than 25 percent of any window pane. 18. Buzzer Alarm: There shall be no buzzer alarm or intercom system. 19. Inspection: The business shall be available for inspection by the San Gabriel Police Department during business hours. 20. Permit Review: The Police Department shall seek a review of any conditional use permit, and may request additional security measures, at any time that it appears to be in the best interest of the public safety. The following circumstances will be specifically monitored: a. Criminal activity occurring inside or as a result of the location. b. Loitering occurring as a result of the location. c. Noise and/or other nuisance complaints occurring as a result of the location. d. Violation of any condition of approval in the conditional use permit. Finance Department (626) 308-2800 21.
