I read the previously submitted public comments with the litany of issues neighbors of these rentals face daily and will spare you my experiences. My wife and I own our home in the Old Town area and have two short term rentals on our street and numerous more within a block radius. I can assure you the disruptions to neighborhoods are not overstated. A greater burden must be placed on the short term rental operators to police their guests and operators should be accountable to the surrounding neighbors to not infringe on the quiet enjoyment of their property. The Comment: interactive map with rental information is a great tool for neighbors to identify the nuisance rentals near their property. Rigorous enforcement of the short term rental registration will make the map an even more useful tool for neighbors to hopefully address issues with the rentals
in real time. I would strongly suggest an option to report a violation and file a complaint function on the map to streamline the process. Most urgently, the registration should additionally require the operator to provide a contact who is available 24 hours a day, 365 days a year to address issues with renters. The Working Group should explore placing a minimum rental period of a week to help combat party house issues and lessen the negative impacts of transient traffic in our neighborhoods. Others, not so much. Knowing this is the case, I believe it's incumbent for the City of Scottsdale to do whatever it takes to immediately identify these TAX PAYING CITIZENS of SCOTTSDALE and assist them in Comment: immediately stopping the nuisance activity that is responsible for their NIGHTMARE. The longer the City of Scottsdale waits to take action to assist these people, I believe the risk of something horrible happening, as a result of being perceived as doing "nothing", grows exponentially. I believe the City is collectively crossing their fingers and hoping this situation doesn't spiral out of control. We're all hoping it doesn't spiral out of control. It will be shared with the working group members. Thank you for calling the police so they can handle this under the nuisance party ordinance. This information will be shared with code enforcement so they can follow-up with the property owner to share their emergency contact information as required by ordinance. If the property is being used as a short-term rental, and they are listed on VRBO or Airbnb it is likely that they are paying taxes, because that is a requirement of being listed on those platforms. Both are NOT intended for parties, but for families. We do our best to carefully screen our guests, inquiring as to the purpose of their trip. We are fortunate that we've had only one party in the 3 years we've been doing this. Impressive! We need to keep this simple to achieve results. This is a request to improve the City Code Enforcement process, so Client Privilege is not a factor as it is NOT about my personal situation (I have been told I can't approach the city lawyers because of "Client Privilege"). Therefore I believe it is necessary and reasonable to ask Ms. Scott's to investigate the legal possibility of allowing renter testimonies as evidence of code violations (which the city has allowed in the past). Such an evaluation should be documented and shared with citizens. The explanations provided by non-legal folks of the City makes no sense to any of us: That written testimonies from verified renters is only “hearsay” within “hearsay” evidence, and not submissible as evidence in court. The term “hearsay” refers to an out-of-court statement made by someone other than the witness reporting it. For example, while testifying in John's murder trial, Anthony states that John's best friend told him that John had killed the victim. If properly addressed, I believe that a legal expert like Ms. Scott (and her team) will find that; 1. Both AirBNB and VRBO certifies that testimonies on their platforms are limited to verified renters who booked that specific property, paid for their vacation with their credit card, submitted a clear picture of their drivers licence, provided street address and phone number and signed the contract). Noone else can post a review. 2. Both AirBNB and VRBO have an easy process for Municipalities to Subpoena records because several municipalities have already fought that battle (sources provided earlier). Scottsdale can use the same process if needed at limited cost. This seems far from "hearsay within hearsay"................... That means that these testimonies are akin to notarized, written testimony (written testimony where identity has been verified). Esteemed members of the City (on this email); I think you have an enormous opportunity to fulfill your campaign promises, protect hundreds of Scottsdale families and create a legacy with very little effort. An unafraid approach to protect your citizens will be uncomfortable, but you will be a shining example for others on how to focus on solutions, cut through red tape, work for the citizens and not cave to pressure.
