Rapid steps towards a digital green certificate

                Resumen In March 2021, the European Commission put forward a legislative proposal on a 'digital green certificate' that aims to
                           facilitate free movement within the EU. The certificate would be available for Union citizens and their family members
                           to indicate that they have either received a Covid-19 vaccine, had a recent negative test result, or have recovered from
                           Covid-19. The proposal is complemented by another legislative proposal, which ensures that same rules apply to third-
                           country nationals in the EU. With a view to the introduction of the certificate by summer 2021, the European Parliament
                           decided to discuss the proposal under the urgent procedure. The Council has already agreed a mandate for
                           negotiations. Parliament is expected to adopt its position during its April 2021 session so that interinstitutional
                           negotiations can start as soon as possible thereafter in order to have the framework in place by summer 2021.

                Resumen Given the extent of inequality and discrimination, challenges to fundamental rights and citizens' lack of awareness of
                           the rights they enjoy, the EU institutions have recognised the importance of funding to protect core EU values and
                           fundamental rights, support civil society organisations and sustain open, democratic and inclusive societies. In May
                           2018, the European Commission adopted a proposal for a regulation establishing a new Rights and Values
                           programme as part of the new 2021-2027 Multiannual Financial Framework (MFF). An early second-reading
                           agreement was reached with the Council in trilogue negotiations, which is now expected to be voted by Parliament
                           during the April 2021 session.

                Resumen On 17 March 2021, the European Commission put forward a proposal for a regulation on a 'digital green certificate'
                           allowing for safe and free movement of EU citizens during the pandemic, and an accompanying proposal covering
                           third-country nationals legally staying or residing in the EU. The certificate would provide proof that the person has
                           been vaccinated, give results of Covid-19 tests and/or information on the acquisition of antibodies. The aim is to help
                           restore free movement of people in the EU. On 25 March 2021, the European Parliament decided to accelerate work
                           on the Commission proposals, using the urgent procedure.

                 Resumen Presently, the Schengen Area is confronted with a different reality than in 2016, when the European Parliament and
                           Council approved Regulation (EU) 2016/399 (as codification of Regulation (EC) No 562/2006 and its subsequent
                           amendments), establishing a Union Code on the rules governing the movement of persons across borders (Schengen
                           Borders Code). As stated in the Commission Work Programme of 2021, the current health crisis and pandemic, and
                           recent developments - related to security concerns and the arrival of refugees -, have exposed the EU’s need to
                           strengthen its crisis preparedness and management of cross-border pressures, as well as keeping the Schengen
                           legislation updated, making it suitable to endure the test of time.

                Resumen This At A Glance summarises the key findings of the original study, which analysed the role and development of Points
                           of Single Contact and other information services. The study reviewed recent policy documents, and identified a range
                           of weaknesses for the provision of contact points. The main recommendations were to improve monitoring (using the
                           indicators and the Single Market Scoreboard) and make use of infringement proceedings in case of non-compliance.
                           The actions could be built on the instruments available under the recent Single Digital Gateway Regulation.
                           This document was provided by the Policy Department for Economic, Scientific and Quality of Life Policies at the
                           request of the committee on Internal Market and Consumer Protection (IMCO).

                Resumen This EPRS paper analyses the implications of Brexit for the rights of both European Union and United Kingdom
                          citizens and provides an overview of the rights protected by the Withdrawal Agreement, which entered into force on 1
                          February 2020, as well as of the national measures envisaged by the UK and the EU Member States to give effect to
                          the relevant provisions thereof. As a result of the UK leaving the EU and becoming a third country, UK citizens are no
                          longer EU citizens and they will therefore lose a series of rights based on EU citizenship once the transition period
                          provided for in the agreement expires. Currently, UK and EU citizens may still move to the EU and the UK respectively,
                          under the applicable EU rules. Beyond the end of the transition period, the agreement guarantees the rights of EU and
                          UK citizens who had made use of their freedom of movement rights by the end of 2020.

Repatriation of EU citizens during the COVID-19 crisis: The role of the EU Civil Protection Mechanism

                Resumen According to official estimates, the COVID-19 crisis has left more than 200 000 EU citizens stranded outside the
                          borders of the EU. EU Member States have been making great efforts to retrieve them, often with the help of the EU.
                          The priority has been to return EU citizens by using commercial flights, but as the conditions continue to worsen, other
                          resources have had to be utilised. EU Member States can activate the EU Civil Protection Mechanism to facilitate the
                          repatriation of their and other EU citizens, if the Emergency Crisis Response Centre assesses that there is no better
                          way. So far, at least 15 countries are reported to have requested the help of the Civil Protection Mechanism, using it to
                          organise flights co-funded with EU funds, and so far repatriating 4 382 EU citizens (and 550 others), first from China,
                          and then from a wide range of countries, including Cape Verde, the Dominican Republic, Egypt, Georgia, Japan,
                          Morocco, the Philippines, Tunisia, the USA and Vietnam. More flights are scheduled to bring people back from other
                          locations. The EU Civil Protection Mechanism has been used more than 300 times to respond to disasters since its
                          establishment in 2001. All the EU Member States, together with Iceland, Montenegro, Norway, North Macedonia,
                          Serbia and Turkey, participate in the Mechanism, but it can also be activated by any country in the world and by certain
                          international organisations. Once the Mechanism is activated, a number of steps follow. The Emergency Crisis
                          Response Centre, as part of the Mechanism, decides on the best response and coordinates it. The EU funds up to 75
                          % of the costs of the deployment of resources. The 2019 upgrade of the Mechanism boosted the joint capacity for
                          responding to disasters, including medical emergencies. It created rescEU, a reserve of capacities, which has now
                          been augmented to include a stockpile of medical equipment for the COVID-19 response, 90 % of which is funded by
                          the EU. On 27 March 2020, the Commission proposed to further boost the budget for repatriation and for the rescEU
                          stockpile.

EU policies – Delivering for citizens: Youth empowerment

                 Resumen The proportion of young people (15-29 years old) in the general EU population is declining. On the whole, young
                           people have a higher level of education than older adults, and youth unemployment rates have begun to decrease.
                           Nevertheless, young people are still more exposed to poverty and social exclusion than other sections of the
                           population. They are less prone to put their health at risk than previous generations. For instance, fewer young people
                           smoke, get drunk, or become involved in a road accident than previously, but young people are still over-represented
                           among those who are injured in road accidents. Obesity due to bad eating habits and lack of physical exercise is still
                           an issue. Young people are also less likely to vote, or stand for election than older adults, but in recent years there has
                           been a slight increase in interest in politics, political action and volunteering. Almost 80 % of young Europeans identify
                           themselves as European citizens. In a Eurobarometer survey published in 2018 they placed education, skills and the
                           environment at the top of a list of priorities for the EU. The European Union is engaged in helping Member States
                           address young people's needs and aspirations through a youth strategy which covers areas such as employment,
                           entrepreneurship, social inclusion, participation, education, training, health, wellbeing, voluntary activities, the global
                           dimension, creativity and culture. The strategy is backed by a number of funding programmes that are specifically
                           focused on young people, most notably the Youth Employment Initiative, Erasmus+ and the European Solidarity
                           Corps. It also draws from funds directed at other specific policy areas. EU action in the area of youth empowerment is
                           best known for the mobility opportunities it has created, in particular through Erasmus. Future challenges include
                           reaching a wider spectrum of young people, especially those from disadvantaged and hard-to-reach groups, making
                           the results of the consultative process, known as youth dialogue, more tangible, and improving synergies between
                           policy areas for greater effectiveness. This is an update of an earlier briefing issued in advance of the 2019 European
                           elections.

Is transparency the key to citizens’ trust?

                Resumen Trust in political institutions is a key element of representative democracies. Trust in the rule of law is also the basis for
                           democratic participation of citizens. According to the spring 2018 Eurobarometer survey of public awareness of the EU
                           institutions, 50 % of respondents indicated they trust the European Parliament, which represents a 34 % increase
                           since the beginning of the 2014-2019 legislative term. A transparent political decision-making processes has become a
                           common objective to help strengthen citizens’ trust in policy-makers and enhance the accountability of public
                           administrations. In this regard, regulation of lobbying (the exchange between policy makers and stakeholders), and
                           bolstering the integrity of this process, is often considered a vital ingredient. Public expectations for increased
                           transparency of the exchange between policy-makers and interest representatives varies from one political system to
                           the next, but it has increasingly become a topic of debate for parliaments across Europe, and a regular demand during
                           election campaigns.

Technology and social polarisation

                 Resumen With the Cambridge Analytica scandal, it became clear how technologies such as social media and techniques such as
                           psychological profiling can be combined in election campaigns with worrying effects. Personalised political messaging
                           is highly automated. It starts and ends with social media, which provides both the data for categorising users and the
                           medium for targeting them with personalised messages. Messages might be designed to favour a particular candidate
                           or to encourage widespread discord and mistrust. In either case, it could lead to more polarised societies in which
                           citizens share less common ground and are less understanding of those with different political ideologies, attitudes to
                           populism, or perspectives on specific topics such as immigration. These same technologies and techniques also shape
                           trends in news production and consumption. As newspaper sales dwindle, outlets increasingly rely upon ad-revenue
                           generated by clicks, making extensive use of social media platforms and user profiling. Public debate increasingly
                           occurs via these social media platforms in which citizens, politicians, companies and bots communicate directly to
                           each other without the traditional filters of journalistic standards and editorial oversight. It has been suggested that,
                           where citizens increasingly rely on such platforms for news, they risk entering so-called ‘filter bubbles’ in which they
                           are exposed to a narrow range of perspectives oriented around their own profiles, shielded from contrasting views, in a
                           broad trend that could also lead to more polarised societies. In this context, STOA launched two studies to explore the
                           mechanisms by which these technologies and techniques may foster polarisation in Europe. One study approached
                           the question with reference to trends in the production and consumption of news media, while the other focussed on
                           trends in political campaigning and communication strategies.

                 Resumen Currently, there are at least 86 different versions of ID cards, and 181 types of residence documents in circulation in
                           the EU. The format and minimum standards for ID cards and residence documents is not regulated on EU level. In
                           order to strengthen the security features of ID cards and residence documents of EU citizens and their non-EU family
                           members, the European Commission published a legislative proposal. The impact assessment accompanying this
                           proposal clearly explains the problems currently encountered, and proposes adequate solutions. The Commission
                           used different sources to substantiate the impact assessment and also undertook several stakeholder consultation
                           activities. However, it is not systematically indicated which stakeholder group prefers which specific option. At times
                           the impact assessment displays a lack of quantification, about which the Commission is open. More detailed
                           information on the safeguards regarding the fundamental rights impact would have been desirable.

The Brexit process: Moving to the second phase of negotiations

              Resumen The first phase of Brexit talks between the EU and UK negotiating teams needed six rounds of discussion over seven
                        months. Finally, on Friday 8 December, an agreement in principle on the three priority issues – citizens’ rights, a
                        financial settlement and Northern Ireland – was reached. The European Commission President, Jean-Claude Juncker,
                        and the UK Prime Minister, Theresa May, endorsed a joint report setting out a common understanding on the future
                        withdrawal agreement. Whilst a number of specific aspects are still under discussion, the European Council decided on
                        15 December that 'sufficient progress' had been achieved on the first-phase priority issues, and that negotiations could
                        move on to the second phase – on transitional arrangements and the future EU-UK relationship – provided the
                        commitments from the joint report are fully translated into the draft withdrawal agreement. For the transitional period,
                        the European Parliament and the European Council have made clear that all existing Union regulatory, budgetary,
                        supervisory, judiciary and enforcement instruments and structures must apply, including the competence of the Court
                        of Justice of the European Union, but with no UK participation in decision-making, since it would no longer be a
                        member of the EU. Exploratory discussions on the framework for the future relationship will begin only after the
                        adoption by the European Council of additional guidelines in March 2018. The UK has still to clarify its position on the
                        type of trade deal it seeks with the EU.

              Resumen In December 2015, the results of elections to the Venezuelan National Assembly saw the Democratic Unity
                        Roundtable coalition (MUD) prevail by a wide majority over the ruling Socialist Unified Party of Venezuela (PSUV) of
                        President Nicolás Maduro. Since then, Venezuela has faced increasing political crisis. Initiatives by the duly elected
                        Parliament have been systematically blocked, first by the Supreme Court of Justice (TSJ) and the National Electoral
                        Council, and since August 2017 by the new National Constituent Assembly, which has taken over most of the
                        Parliament's legislative powers. Two attempts at dialogue between the Venezuelan government and the opposition,
                        promoted by international mediators, have so far failed to break the deadlock. The economic and social situation in the
                        country is far from improving, and the number of Venezuelan asylum-seekers abroad has risen exponentially.
                        Nevertheless, regional elections were finally held on 15 October 2017 – with a PSUV victory in 17 of the 23
                        Venezuelan states, amid accusations of fraud from the opposition – and the government has promised to go ahead
                        with the presidential elections due in 2018. This is an update of a briefing published in October 2017.

                         examines ways in which – through differentiation and ‘flexible and imaginative solutions’ – the Agreement can be
                         upheld and the context for its effective implementation maintained.

                Resumen This note seeks to provide an initial analysis of the strengths and weaknesses of the European Commission's Impact
                          Assessment (IA) accompanying the above proposal, submitted on 2 May 2017 and referred to Parliament's Committee
                          on Internal Market and Consumer Protection. The initiative seeks to reduce as much as possible the additional
                          administrative burden that EU citizens and businesses face when they expand their activities to other Member States.
                          To achieve this, the IA explains that the single digital gateway should provide access to the national rules,
                          requirements and procedures that citizens and businesses from other Member States need to know about and comply
                          with. To assist the user with this journey, the gateway should cover three layers, namely information, procedures and
                          assistance services. The REFIT Platform Government Group confirmed the significance of a 'user journey approach'
                          (IA, p. 5). The proposal on the single digital gateway is one of the initiatives falling under the Commission's 2015 single
                          market strategy. The proposal also forms part of the 'compliance package', which, alongside the single digital gateway,
                          sets out a single market information tool and the SOLVIT action plan. In addition, the REFIT Platform (consisting of
                          business stakeholders and Member State representatives) published an opinion in June 2016 recommending the
                          establishment of a single entry point with clear information and coordinated services for businesses in each Member
                          State to assist companies operating in the single market, and the definition of minimum common quality criteria for
                          content.

                Resumen Following the success of the European Year of Languages (2001), the Council of Europe designated 26 September as
                           the European Day of Languages. Since then, annual celebrations of this day have been held to promote the rich
                           linguistic and cultural diversity of Europe. The European Parliament has consistently acted to support endangered
                           languages and linguistic diversity in the EU, calling on the EU and the Member States to commit resources to their
                           protection and promotion.

                Resumen Since their official launch in June 2017, three rounds of negotiations on the United Kingdom's (UK) withdrawal from the
                           European Union (EU) have been held. So far, the EU and UK have discussed the priority issues of citizens' rights, the
                           financial settlement and the Irish border, but disagreements and ambiguities persist. After the third round, 'no decisive
                           progress' was reached, according to Michel Barnier, the EU chief negotiator, which is likely to impede any advance to
                           the second phase of talks in October, on transitional arrangements and the future EU-UK partnership, including trade
                           relations.

                 Resumen The first three rounds of negotiations on the terms of the United Kingdom's withdrawal from the European Union have
                           generated only modest progress, with the two sides divided on the first-phase issues, namely the size of the UK's

                           Brexit, and the specific problem of how to deal with the border between Northern Ireland and the Republic of Ireland.

                Resumen Negotiations on the arrangements for the UK's withdrawal from the EU started on 19 June 2017. The European
                           Commission is negotiating on behalf of the EU, on the basis of the European Council guidelines and the mandate
                           given to it by the Council. The European Parliament, for its part, has laid down key principles and conditions for its
                           approval of a UK withdrawal agreement. Three key priorities are set to dominate the first phase of the negotiations
                           (with the future relationship between the EU and the UK being left to a second phase). These are: citizens' rights for
                           EU-27 citizens in the UK and UK citizens in the EU-27; the settlement of the UK's financial obligations; and ensuring
                           the Northern Ireland peace process is not compromised. This paper looks at the EU negotiating position and the major
                           issues raised under those three priorities to date.

                 Resumen Upon request by the PETI Committee, this study considers issues raised in petitions to the European Parliament by
                           citizens concerned about the way Brexit will impact on their rights. In particular, it first looks at the changes that Brexit
                           will determine in relation to voting rights, the right to petition, the right to apply to the European Ombudsman and the
                           European Citizens’ Initiative. It then focuses at length on the way Brexit will affect UK citizens in the EU-27, and EU
                           citizens living in the UK. In this respect, it considers challenges and risks for both citizens who have resided in the EU-
                           27 or the UK for less than 5 years, and for those who have already acquired the right to permanent residence at the
                           time of Brexit.

               Resumen European citizenship is enshrined in the Treaties (Article 20 of the Treaty on the Functioning of the European Union
                         (TFEU) and Article 9 of the Treaty on European Union (TEU)). It is an essential factor in the formation of a European
                         identity. European citizenship exists as a complement to citizenship of a Member State. The main difference between
                         the two is that the rights that citizens enjoy as a result of European citizenship are not matched with duties.

               Resumen This desk research focusses on the major shifts in European public opinion towards the European Union since 1973,
                        when Eurobarometer was created by Jacques-René Rabier. The results are presented in a timeline and illustrate the
                        evolution of citizens' opinion in the key phases of the Union's institutional, political, economic and social development.
                        This is the second edition of the 2014 Desk Research, updated with results of the 2015 Parlemeter. The main findings
                        on the evolution of public opinion in the last 40 years  from 1973 to 2014  show that it has gone up and down, notably
                        in response to financial, economic and social crises. The major institutional and political staging-posts in the EU's
                        development have generally improved the perception of the EU. This is particularly true of enlargements and elections
                        to the European Parliament. This analysis shows the overriding influence of the economic and social context on public
                        opinion. This is very well illustrated by the financial and economic crisis which began in 2008, prompting a sharp
                        decline in indicators of support for the EU. However, even in this context of crisis, results show that Europeans remain

               Resumen The right to vote is a fundamental one and of utmost importance for the democratic legitimacy of any public power. Six
                       EU Member States deprive their nationals permanently resident abroad of the right to vote in national parliamentary
                       elections. They also deprive such citizens residing in a third country of the vote in European elections, and two of them
                       even when their nationals live in another EU Member State.

                           Citizens disenfranchised in their country of origin often face exclusion from political life at national level in both their
                           country of origin and of residence. In the case of citizens living in another EU Member State, the disenfranchisement
                           rules could even amount to an infringement of their freedom of movement and residence under EU law.

                           Solutions discussed include a Treaty change to allow EU citizens to vote in national parliamentary elections in their
                           host Member State or to be able to choose between voting there or in their Member State of nationality. A more
                           realistic solution envisages the abolition of disenfranchisement rules in those six Member States concerned, although
                           such calls from EU institutions have found very limited favour in the six concerned.

              Resumen Upon request by the LIBE Committee, this study surveys the US legal system of data protection in the field of federal
                       law enforcement. It reviews two principal sources of US data protection law, the Fourth Amendment to the US
                       Constitution and the Privacy Act of 1974. It also considers the legally prescribed methods of data collection, together
                       with their associated data protection guarantees, in ordinary criminal investigations and national security investigations.
                       Throughout, the study pays special attention to the rights afforded to EU citizens.

'Foreign fighters' - Member States' responses and EU action in an international context

              Resumen As the hostilities in Syria and Iraq continue and terrorism activities worldwide seem to be on the rise, EU Member
                        States are increasingly confronted with the problem of aspiring and returning 'foreign fighters'. Whereas the
                        phenomenon is not new, its scale certainly is, which explains the wide perception of these individuals as a serious
                        threat to the security of both individual Member States and the EU as a whole. The problem has been addressed within
                        international fora including the United Nations, which in 2014 adopted a binding resolution specifically addressing the
                        issue of foreign fighters. The EU is actively engaged in relevant international initiatives. Within the EU, security in
                        general and counter-terrorism in particular have traditionally remained in the Member States' remit. The EU has
                        however coordinated Member States' activities regarding the prevention of radicalisation, the detection of suspicious
                        travel, criminal justice response and cooperation with third countries. The EU is seeking to strengthen its role given the
                        widely shared feeling of insecurity in the wake of recent terrorist attacks. Existing and new paths for EU action are
                        being explored, including the revived EU passenger name records (PNR) proposal. Individual Member States have
                        stepped up their efforts to address the problem using various kinds of tools including criminal law, administrative
                        measures and 'soft tools', such as counter-radicalisation campaigns. The Member States most affected have also
                        cooperated with each other outside the EU framework. The United States has a particularly developed counter-
                        terrorism framework now being used to deal with foreign fighters. Since 9/11, the EU and the US have cooperated on
                        counter-terrorism despite different philosophies on issues such as data protection.

                 Resumen The right to vote in elections is a fundamental right common to the constitutional traditions of the Member States, and
                         recognised in the EU Treaties as intrinsically related to the right of political participation which, for its part, provides
                         democratic legitimacy to those exercising public power. This right is not absolute though and is subject to restrictions.
                         The decision of who is conferred the right to vote in national and also in European elections lies with states.

                            Six EU Member States deprive their nationals, under varying conditions, of the right to vote in national parliamentary
                            elections due to residence abroad, both in other Member States and in third countries. These same six Member States
                            also disenfranchise their nationals in European elections, if they live permanently in a third country, and two of them
                            even do so in respect of nationals resident within the EU.

                            'Disenfranchisement' due to residence abroad can be a result of minimum residence requirements in the country in
                            which elections take place as well as of losing electoral rights due to time spent abroad. The lack of facilities to vote
                            from abroad, while rendering the exercise of voting rights difficult, does not amount to their loss as
                            such.Disenfranchisement is based on the assumption that expatriates are not affected by the political decisions taken
                            in their country of nationality and that they are not able to cast a meaningful vote due to lack of knowledge of the
                            political reality there. Globalisation and improved communication means have however induced a tendency towards
                            enfranchising expatriates.

                            Citizens deprived of their right to vote in national elections in their country of nationality often face exclusion from
                            political life at national level in both their state of residence and their state of origin since EU Member States (and more
                            so third countries) do not generally provide any right to vote in national elections to non-nationals. Whilst the European
                            Court of Human Rights saw no infringement of Convention rights from disenfranchisement rules, the loss of electoral
                            rights for citizens who move to another EU Member State could be seen as an infringement upon the freedom of
                            movement under EU law, since it could potentially stop EU citizens from exercising their free movement rights.

                            Different solutions have been discussed. Actions at EU level include a possible infringement procedure against those
                            Member States who disenfranchise their nationals resident elsewhere in the EU, as well as a Treaty change to include
                            a voting right for EU citizens in their host Member State or the right to choose to vote in national elections either in their
                            Member State of nationality or in the host Member State. Another proposal, which is more realistic in the short term, is
                            to convince Member States to enfranchise nationals living in another EU Member State or at least to enhance the
                            conditions for them to preserve their right to vote.

                Resumen The European Commission's proposal for the setting up of a European Voluntary Humanitarian Aid Corps (EVHAC) is

                 Resumen The EU-Switzerland Agreement on the Free Movement of Persons, signed in 1999, is linked to six other agreements.
                           As the EU incorporated new Member States, the bilateral agreements with Switzerland were extended to new EU
                           countries. The Swiss government has already applied a ‘safeguard clause’ to limit the longterm residence permits for
                           EU citizens. The Swiss authorities must implement the referendum within three years. The EU may choose among
                           different courses of action, which would involve the European Parliament to different degrees. The seven linked
                           agreements could be terminated… or suspended. Negotiations on the wider institutional framework for bilateral
                           relations may also be frozen. The referendum confirms the need for a new framework.
