Unfortunately, we were unable to pass this issue. Monthly Update Diana Augustine, Executive Secretary COMMUNITY LINK june 2018 CONGRATULATIONS EMPLOYEE OF THE MONTH Myra Staresina Severyn, Macedonia Prosecutor My name is Myra Staresina Severyn, and I am your Macedonia Prosecutor. I have prosecuted on behalf of the City of Macedonia since May 1996—initially as Assistant Prosecutor, and, as of January 2009, Prosecutor. I have been an attorney for 30 years and graduated from Case Western Reserve University School of Law in 1987. I am licensed to practice law in both California and Ohio. As part of my duties and responsibilities as the Macedonia Prosecutor, I enforce the Codified Ordinances of the City of Macedonia and the laws of the State of Ohio, including criminal, traffic and building code violations. What is the role of a prosecutor? There are typically two schools of thought. The first is that the role of a prosecutor is to obtain a conviction. The second is that the role of a prosecutor is to do justice. I have always believed my primary duty is to do justice, and I support the American Bar Association definition of prosecutorial function as the “duty to seek justice, not merely to convict.” The duty to seek justice means that I review each case critically and make every opportunity to speak with not only the victim in the case, but also the witnesses and the defendant, or the person being charged. I often receive direct telephone calls from members of the public about a case that they believe ought to be pursued, and when I do, I routinely direct those individuals to the Macedonia Police Department. If you believe that you are a victim of a crime, the first step in the process is to contact the Macedonia Police Department. An officer will be assigned to investigate your case. I am often contacted at the conclusion of an investigation regarding potential charges, but more often than not, I first learn of a case well after charges are filed and after the defendant appears in court and pleads “not guilty.” The matter is then scheduled for a pre-trial. A pre-trial is an opportunity to speak with the defendant or his or her attorney in order to resolve a case without going to trial. If a resolution is not reached, the matter is then scheduled for a trial. If a crime occurs in the City of Macedonia, any resulting case may be filed in our Mayor’s Court, the Stow Municipal Court, or, if it is a felony, in the Court of Common Pleas. The City of Macedonia maintains a Mayor’s Court for the convenience of its citizens. If a case is pending in the Mayor’s Court, I am present at the time of the arraignment or the initial appearance. I often speak with defendants at that time regarding a potential resolution of the case. Many of the cases in our Mayor’s Court are traffic offenses, and Driving Under Suspension (“DUS”) is one of the most common traffic matters that we handle. If an individual is in court for a DUS, I routinely take the time to discuss the defendant’s driving record, including the reason for the suspension and what I believe needs to be done to clear the suspension. If the case resolves at the arraignment, then no further court appearance is required. If the case is pending in the Stow Municipal Court, the initial appearance is before a Judge or Magistrate. Prosecutors do not routinely attend the arraignment. The defendant is able to plead “guilty,” or, if appropriate, “no contest” at that time to resolve his or her case. The defendant can then change his or her plea to resolve the case or maintain the previously entered “not guilty” plea and proceed to trial. A trial is before a judge or, if the charge carries with it the potential for jail, before a jury. I have witnessed many changes in the City of Macedonia since I began prosecuting on its behalf, and all of those changes have resulted in its reputation as one of the premier communities in Northeast Ohio. Many factors go into assessing the quality of a community and in its reputation. Safety and security are always key to a City’s reputation. Low crime is associated with committed law enforcement by all parties, including the victims, whether persons or retailers, the police, and the prosecutor. We all work together in decreasing crime in the City. When I became Prosecutor in 2009, one of our largest retailers was not actively reporting or prosecuting shoplifters. After a couple of years, they began to do so. The loss prevention officer told me years later that when that store started to aggressively prosecute shoplifters, there was a bin in the store where employees put empty containers from items that had been stolen after they were removed from the containers. I was told the loss was approximately $1.2 million dollars annually just from computing the value of the items stolen from the empty containers. After almost 3 years of sending the message that shoplifters will be prosecuted in Macedonia, I was told the empty boxes in the bin had been reduced to an annual loss of approximately $375,000. We can and have sent the message that we will pursue thefts and other crimes that occur in Macedonia, and based upon the information that was conveyed from at least one of the stores in The Commons, fewer people are coming to steal in the City of Macedonia when they know that prosecution is likely to occur if they are apprehended. Another factor in the reputation of a community is the aesthetics of the City and the adherence to the Building Code. If you are contacted by our Building Inspection, know this. He is helping you as the resident or business owner to maintain your investment in the property that you own in Macedonia. The goal of the Building Department is compliance with the Building Code and not revenue. Every effort is made to consider the needs of the resident or business owner, but the goal of compliance with the Building Code is and must be achieved in order to protect all who live or own property in the City. Finally, many years ago I started an informal mediation program for those disputes that are driven primarily by emotion and that tend to escalate to criminal charges if not addressed at the inception of the problem. Neighbor disputes and boyfriend/girlfriend relationships are often appropriate for mediation. Effective law enforcement is truly a collaboration between the victim, the police and the prosecutor. When we all work together, we can reduce crime and elevate the reputation of the City as a desirable place to live and work. With all the beautification efforts being done by various organizations and citizens, the City has received an increased number of complaints about trash and recycle cans left curbside, or in front of the house, on a permanent basis. Garbage cans are unsightly, not to mention that garbage cans in front of the house can really put a dent in your home’s curb appeal. This notification is being provided as a courtesy for residents to be made aware of the City’s policy on this matter, and to help spread the word. Macedonia Ordinance 1365.13 Rubbish and Garbage Disposal states, “No waste container or other item for disposal shall be placed between the building setback line and the street before 12:00 p.m. of the day before pickup, nor left after 7:00 p.m. of the day of pickup.” With the exception of collection day and the hours noted above, the City is asking that all residents’ help to Keep Macedonia Beautiful by placing trash and recycle containers in the most inconspicuous location on the property. Acceptable places include inside the garage or shed, and the side and rear yards, as indicated on the diagram to the right. Albeit, wheeling the large trash and recycle containers from the side or rear yard to the curb may be slightly more difficult and time-consuming, especially during the winter months, but elimination of garbage cans from street view will definitely be aesthetically pleasing to the eye, and a good thing for property values. Building Department City Engineer, Joe Gigliotti COMMUNITY LINK june 2018 CITY OF MACEDONIA Building/Engineering The Crossroads of Northeast Ohio Zoning Department MEMORANDUM Road Program A total of thirty-three streets are currently under contract to be paved as part of the 2018 Road Program. Through a competitive public bidding process, Specialized Construction has been awarded the paving contract these roads. Construction is taking place concurrently on many roads. As such, some roads are in different stages of reconstruction than others, and there are some roads in which the work has not yet begun. Shepard Hills Boulevard and Robin Lane Water Main Improvements Water main improvements are scheduled for both roads in 2018. The City has received complete grant funding to perform this work. Once the water main work is complete, each road will be repaved. All affected residents will be given advance notification of this work. Fire Department Tim Black, Fire Chief COMMUNITY LINK june 2018 WHY FLUSHING HYDRANTS AND 'WASTING' WATER KEEPS YOU SAFE Flushing hydrants can be frustrating to residents in places with low water supplies, but it is essential to ensuring clean and safe water. You have probably seen it many times and thought to yourself, "what a waste of good clean water!" Flushing hydrants can be frustrating to residents in places with low water supplies or those who pay high premiums to keep their taps flowing. While it may seem like a waste of good clean water, flushing of hydrants is essential to keeping your water safe and maintain the integrity of a pipe network. Flushing hydrants can be done to not only test the fire flow capacity in the event of a fire, but also to remove sediment and rust from the water, or to maintain proper chlorine concentrations in your area. First, let's look at flushing hydrants for the purpose of keeping chlorine concentrations high for disinfection purposes. Chlorine additions are common disinfection procedures in US water treatment plants, and it ensures that bacteria are not thriving in the water or pipe network. However, chlorine naturally degrades the longer it is in water, which means that water sitting in pipes for long periods of time or further out from the treatment plant can have concentrations lower than acceptable, creating danger. Hydrants are flushed to keep water moving and keep pipes from stagnating in this case. Another reason hydrant flushing can be necessary is if water becomes stagnant in pipes, or water becomes contaminated. Sediments, rust, and even chemicals can sometimes leach into a water system from broken pipes or even the linings of the pipes themselves. Engineers recognize this risk and determine key locations where hydrant flushing will increase water quality. The final reason hydrants may be flushed is to test or record flow values. Certain codes indicate the necessary fire flows from hydrants in order to maintain safety in the event of a disaster. Pressures and flow rates at hydrants can be drastically affected by other users' usage of water, or even possibly a burst pipe. Periodical testing ensures that there is enough water supply, which also can affect home and business owners' insurance rates. To summarize, if you see a fire hydrant running for hours on end, it isn't the city just wasting water. If the city could keep the water, they would. After all, no one is paying for the water being flushed from a hydrant so ultimately the water utility loses some money. Now, you may say why not transport the water unsuitable for drinking to water a park or put it to good use? While this is a noble venture, it often proves much too costly, and dumping the excess down storm drains is the only viable solution. Camp is primarily held outside at the pavilion area of Longwood Park within walking distance to fields/open grass areas, lake, trails, & rec center. Camp Macedonia campers swim up to four times a week at the Macedonia Family Recreation Center. Macedonia Rec. Center offers 2 pools (0-4ft & 3.5-11ft) for the campers to use. Swim activities include games and open play. Special field trips are scheduled each week excluding July 4th week. Campers are transported by school bus. Each week offers a new theme and activities surrounding that theme. Your camper can enjoy cookouts every Friday instead of bringing a lunch. Field trips include: Water Works Park, Fun N Stuff, Cleveland Metroparks Zoo, Nickajack Farm, Camp Hi, Akron Rubberducks, Roseland Bowling. RAIN BARREL WORKSHOP On May 22nd we hosted another Rain Barrel Workshop with Kate Chapel from Tinker’s Creek Watershed Partners and Sandy Barbic from Summit Soil & Water Conservation District. The event was for anyone interested in starting their own rain barrel system. The participants learned how rain barrels can divert hundreds of gallons of stormwater over their lives and to use it to irrigate their yard and gardens. They had hands on experience where they made their rain barrel on site. They also learned that they can possibly be eligible for a credit toward their stormwater utility fee. Scalise CPA, CFE has announced that legislation to help protect Ohio’s seniors and other unsuspecting populations against deceptive marketing practices has unanimously passed by both the House and Senate Chambers. Amended House Bill 52 makes several reforms to regulate the solicitation of real property deeds. Amended House Bill 52 comes in response to deed solicitation scams plaguing many Ohioans, including the elderly and first time homeowners. These scams involve companies outside of Ohio sending official looking notifications to property owners, instructing them to acquire a copy of their deed at the cost of $80-$90. Homeowners are often unaware that they can obtain a certified copy of their deed directly from the Summit County Fiscal Office for only $5. “Thank you to the Ohio legislature for protecting our property owners from consumer scams like this,” said Fiscal Officer Scalise. “I want Summit County homeowners to know that they can obtain a copy of their deed directly from my office, without the assistance of a third party. The cost for a printed copy is $4, plus an additional $1 if you would like the deed certified. Electronic copies can be downloaded from our website at no cost.” The provisions under Amended House Bill 52 require that specific disclosures be made to consumers when they are solicited a fee for real property deeds. Companies will now be required to include the cost to obtain the deed from the county recorder, the contact information for the county recorder, and the name and address of the person soliciting the fee. The bill also prohibits charging a fee of more than four times the cost to obtain a copy of the deed from the county recorder.
