This endorsement will not apply to claims made for windscreen damage only, and the amount shown is on top of any other amount which you may have to pay under this insurance. 253 - Unauthorised movement of third party vehicles We will insure you under Section 1 - Liability to others - if a claim arises because an employee of yours, moves without authority, a vehicle not belonging to you or to the employee, to allow parking, loading or unloading or free passage of vehicles owned by, hired or loaned to you. We will insure the vehicle that is moved for accidental damage when it is moved for the above reasons. 713 - Corporate manslaughter £5m If we first agree in writing, we will pay under Section 1 - Liability to others costs for legal services, up to £5,000,000, to defend anyone we insure against a prosecution for corporate manslaughter. We will only pay these legal fees if they arise from an accident that is covered by this insurance. D77 - Trailer cover attached or detached Sections 1 and 2 of your policy document (Liability to others and Loss of or damage to your vehicle) are extended to apply to any trailer which is attached to or detached from your vehicle, provided that the value of the trailer does not exceed £5,000. If the trailer is detached from your vehicle, cover will only apply if, the trailer is fitted with a security device which is in operation when the trailer is not in use; and the trailer is securely parked with the brakes on. If a claim is made which you or anyone acting on your behalf knows is false, fraudulent, exaggerated, or provides false or stolen documents to support a claim we will not pay the claim and cover under this insurance will end. ! We will provide the minimum insurance needed by the relevant law for up to 60 days while you are using your commercial vehicles or private cars in the European Union, Andorra, Iceland, Norway, Serbia or Switzerland (including Liechtenstein). Your permanent home must be in Great Britain, Northern Ireland, the Channel Islands or the Isle of Man and your visit to these countries must be temporary. We can provide full policy cover when you travel abroad or additional countries for which we have agreed to. What are my obligations? - Your premium is based on the information you gave at the start of the insurance and when it is renewed. If you have failed to give us complete and accurate information, this could lead to us changing the terms of your policy, refusing your claim or the insurance not being valid. - In the event of a claim or possible claim: You will need to pay the agreed excess as shown in your schedule. You must notify us as soon as possible of the incident happening. - Windscreen excesses: If your windscreen is replaced by our approved supplier, you must pay the first £75 of any claim. If your windscreen is repaired by our approved supplier, you must pay the first £10 of any claim. If your windscreen is repaired or replaced by any other company, you must pay the first £125 of any claim. How do I cancel the contract? - You may cancel the insurance at any time by informing your broker. - If you change your mind about this insurance, you must advise us within 14 days of the start date. Section 1 Liability to other s Driving your vehicle We will provide insurance for any accident y ou have while you are driving, using or in charge of your vehicle or while you are loading or unloading it . We will insure you for all am ount s you m ay legally have t o pay for causing deat h or injury t o ot her people. The m ost we will pay for propert y dam age is £20,000,000 for any claim or claim s arising out of one incident . We will pay up t o £5,000,000 for any cost s and expenses arising out of a claim or claim s arising from one incident . I f t here is a propert y dam age claim m ade against m ore t han one person covered by t his insurance, we will first deal wit h any claim m ade against you. Driving other cars We will also provide t he cover shown above (if t his is shown in your cert ificat e of m ot or insurance), t o drive any p rivat e car t hat you do not own and have not hired under a hire- perm ission t o drive t he privat e car. You are not insured against : ▪ Any loss or dam age t o t he vehicle you are driving ▪ Any event which happens out side of t he Unit ed Kingdom ▪ Any legal responsibilit y if you no longer have t he insured vehicle ▪ Any event which happens when t his insurance is not in t he nam e of an individual person ▪ Any legal responsibilit y unless t he vehicle is insured against t hird part y road risks, in it s own right or ▪ Securing t he release of a vehicle t hat has been seized by or on behalf of t he police or any public or local aut horit y Other people driving or using your vehicle I n t he sam e way you are insured, we will also cover t he following people: ▪ Any person you allow t o drive or use your vehicle, as long as t his is allowed by your current cert ificat e of m ot or insurance and has not been excluded by an endorsem ent , except ion or condit ion ▪ Any passenger who has an accident while t ravelling in or get t ing int o or out of t he insured vehicle, as long as you ask us t o cover t he passenger Legal personal represent atives Aft er t he deat h of anyone who is covered by t his insurance, we w long as t he claim is covered by t his insurance. Business use (private cars only) I f y our cert ificat e of m ot or insurance allows business use, we will insure your em ployer or business part ner ag ainst t he vehicle provided by t he em ployer or part ner unless t hat vehicle is shown in your schedule. Cover for principals As far as is necessary t o m eet t he requirem ent s of any agreem ent or cont ract ent ered int o by you for t he perform ance of work, we will insure t he principal at your request - provided t he principal com plies wit h t he t erm s and condit ions of t his insurance in so far as t hey can apply. Cont ingent liability We will insure you while an em ployee of yours uses, on y our business, a vehicle you do not own or have supplied as long as: ▪ You have given express perm ission for t he vehicle t o be used on your business ▪ You have giving you cover for such use and ▪ There is no cover provided by any ot her insurance We will not be liable: ▪ For any loss or dam age t o such vehicle or ▪ To cover any person driving such vehicle Joint liabilit y I f t his docum ent is in t he nam e of m ore t han one person, we will cover each person as if we had sent an individual docum ent t o each. We will cover each against t he liabilit y of t he ot her, as long as t he liabilit y, loss or dam age is not covered by any ot her insurance. Unauthorised movement We will insure you in respect of any accident caused by, t hrough or in connect ion wit h t he m ovem ent of any m ot or vehicle not belonging t o you and not in your cust ody or cont rol, as long as t he vehicle is prevent ing your vehicle from passing and: ▪ I s being m oved by an em ployee of yours ▪ I s being m oved in connect ion wit h y our business ▪ I s not t he propert y of t he em ployee m oving it and ▪ I s not covered by any ot her insurance covering such accident , dam age or loss Legal cost s I n respect of any event which is covered under t his Sect ion, if we first agree in writ ing, we will arrange and pay: ▪ Up t o £35,000 t owards your legal fees and expenses for defending legal proceedings, including appeals, and ▪ Up t o £1,000,000 t owards t he cost of any prosecut ion awarded against you arising from any healt h -and-safet y enquiry or crim inal proceedings for breaking t he: • Healt h and Safet y at Work Act 1974 • Healt h and Safet y at Work (Nort hern I reland) Order 1978 or • Corporat e Manslaught er and Corporat e Hom icide Act 2007 We will not provide t his cover: ▪ Unless t he proceedings relat e t o an act ual or alleged act , failure t o act or accident t hat happens during t he period of insurance wit hin t he Unit ed Kingdom and in connect ion wit h y our business ▪ Unless t he proceedings relat e t o an act ual or alleged act , failure t o act or accident arising from you, or a person on y our behalf using, or you having or owning, a m ot or vehicle or t railer where com pulsory insurance or securit y is required by t he Road Traffic Act ▪ For any proceedings which result from your deli berat e act or failure t o act or ▪ Where cover is provided by any ot her policy Emergency medical treatment Where we m ust provide cover under t he Road Traffic Act , we will pay for em ergency m edical t reat m ent t hat is needed aft er an accident involving any vehicle which t his insurance covers. Towing Under t his sect ion we will insure you while any vehicle covered by t his insurance is t owing a caravan, t railer or a broken -down vehicle (as allowed by law). We will only provide t his cover if: ▪ The caravan, t railer or broken-down vehicle is properly secured t o your vehicle by t owing equipm ent m ade for t he purpose and ▪ The m et hod of t owing t he caravan, t railer or broken- lim it s and any ot her relevant law We will not pay any claim arising from : ▪ Loss of or dam age t o t he t owed caravan, t railer or broken-down vehicle ▪ Loss of or dam age t o any propert y being carried in or on t he t owed caravan, t railer or broken -down vehicle ▪ A caravan, t railer or broken-down vehicle being t owed for reward ▪ Towing m ore t railers t han t he num ber allowed by law or ▪ I f m ore t han one caravan or broken-down vehicle is being t owed at any one t im e Cyber Liabilit y Cover We will pay any am ount s you m ay legally have t o pay subject t o t he lim it s st at ed under Sect ion 1 for causing deat h or bodily injury t o ot her people, or propert y dam age, due t o: 1. The use of, or failure of, any applicat ion, soft ware or program m e in connect ion wit h y our vehicle (including any driver assist ance, safet y or securit y syst em s); 2. Any com put er virus, ransom ware, code or soft ware affect ing any elect ronic sy st em s fit t ed t o your vehicle by t he original vehicle m anufact urer; 3. Any t hreat , decept ion or hoax relat ing t o 1 and/or 2 above; subject t o t he t erm s, condit ions, lim it at ions and exclusions of t his policy . Ex ceptions to Section 1 This sect ion of your insurance does not cover t he following: 1. Anyone who can claim for t he sam e loss from any ot her insurance 2. Loss of or dam age t o propert y belonging t o (or in t he care of) anyone we insure and who is m aking a claim u nder t his part of t he insurance 3. Deat h of or bodily injury t o any person arising out of and in t he course of t heir em ploy m ent by t he p olicyholder or by any ot her person claim ing under t his insurance. This does not apply if we need t o provide cover due t o t h e requirem ent s of relevant laws 4. Any legal responsibilit y, unless we need t o provide t he m inim um insurance required by t he Road Traffi c Act , for claim s for deat h, injury , illness, loss or dam age t o propert y arising direct ly or indirect ly from pollut ion or cont am inat ion unless caused by a sudden ident ifiable unint ended and unexpect ed event This except ion: ▪ Relat es t o cont am inat ion or pollut ion caused direct ly or indirect ly by any subst ance, liquid, vapour or gas leaking or being released and ▪ I ncludes cont am inat ion or pollut ion of any building or ot her st ruct ure, wat er, land or t he air We will not pay for claim s arising direct ly or indirect ly from cont am inat ion or pollut ion if it is caused by any subst ance, liquid, vapour or gas being deliberat ely released or leaks caused by t he failure t o m aint ain or repair your vehicle, or any part of i t . 5. Deat h, bodily injury or dam age arising as a result of loading or unloading your vehicle som ewhere ot her t han on t he road by anyone apart from t he driver or at t endant 6. Section 2 Loss of or damage to your vehicle This cover only applies to your vehicle We will insure your vehicle against loss or dam age (less any excess t hat applies) caused by: ▪ Accident al or m alicious dam age, flood dam age or vandalism ▪ Fire, light ning, self-ignit ion and explosion or ▪ Theft or at t em pt ed t heft , or t aking your vehicle away wit hout your perm ission For a claim under this section we will, at our absolute discret ion, either: ▪ Pay for t he dam age t o be repaired ▪ Pay an am ount of cash t o replace t he lost or dam aged it em or ▪ Replace t he lost or dam aged it em The most we will pay will be either: ▪ The UK m ainland m arket value of your vehicle as det erm ined by us, im m ediat ely before t he loss; up t o t he value shown on your schedule or ▪ The am ount it would cost us t o repair your vehicle at an ERS approved repai rer or as ot herwise agreed by our appoint ed engineer whichever is less. We will not pay t he cost of any repair or replacem ent which im proves your vehicle or accessories t o a bet t er condit ion t han t hey were in before t he loss or dam age. I f t his happens, y ou m ust m ake a cont ribut ion t owards t he cost of repair or replacem ent . We will not pay t he VAT elem ent of any claim if you are regist ered for VAT. Excesses I f an excess is shown on y our schedule, y ou have agreed t o pay t hat am ount for each incident of loss or dam age. I f m ore t han one vehicle is insured on your policy and t hey are involved in t he sam e incident , t he excess shown on your schedule will apply t o each vehicle separat ely. Windscreen damage (comprehensive cover only) You m ay t he window or windscreen. The helpline num ber is 0330 123 5991 This benefit does not apply t o dam aged sun roofs, roof panels, light s or reflect ors whet her glass or plast ic. The following excesses apply t o a windscreen claim but t here is no lim it on t he cost of t he windscreen: ▪ I f y our windscreen is replaced by our approved supplier, y ou m ust pay t he first £75 of any claim ▪ I f y our windscreen is repaired by our approved supplier, y ou m ust pay t he first £10 of any claim ▪ I f y our windscreen is repaired or replaced by any ot her com pany, y ou m ust pay t he first £125 of any claim ▪ indows, including bodywork scrat ched by t he breakage, it will not affect your no claim bonus Agricultural vehicles ▪ You m ust pay t he first £50 of any claim regardless of which com pany carries out t he repair or replacem ent ERS POLICY DOCUMENT NUMBER ACFE 1020 11
Extra excesses for young or inexperienced drivers I f y our vehicle is dam aged while a y oung or inexperienced driver (including yourself) is driving, y ou will have t o pay t he fi rst am ount of any claim as shown below. This is on t op of any ot her excess t hat you m ay have t o pay . Drivers Amount Under 21 years of age £300 Aged 21 t o 24 years £200 Aged 25 years or over who has a provisional driving licence or has not held, for 12 £200 m ont hs or m ore, a full driving licence issued by any count ry which is a m em ber of t he European Union. These am ount s do not apply if t he loss or dam age is caused by fire or t heft or where t he insured vehicle is an agricult ural vehicle. Recovery and redelivery Aft er any claim under t his sect ion we will pay t he cost of m oving your vehicle from t he place where t he dam age happened t o t he prem ises of t he nearest com pet ent repairer. We will also pay t he cost of delivering your vehicle back t o y ou in t he Unit ed Kingdom aft er repair. Do not t ry t o m ove your vehicle yourself i f t his could increase t he dam age. I f unnecessary dam age is caused as a result of your at t em pt s t o m ove your vehicle, we will not pay any ext ra cost arising from t hat dam age. All arrangem ent s for st orage of a dam aged vehicle m ust be agreed by us. I f you arrange st orage wit hout our prior knowledge and consent we will not pay any ext ra cost arising from t hat arrangem ent where t his is great er t han t he cost we negot iat e wit h our approved supplier. Repairs I f y our vehicle is dam aged in any way which is covered by t his insurance, y ou should cont act us im m ediat ely . We can, if you wish, organise for our approved repairers t o repair your vehicle. Where using our approved repairer for t he repair of your vehicle, and your vehicle does not exceed 3.5 t onne gross veh icle weight our approved repairer will: ▪ Guarant ee t he repairs for 5 y ears ▪ Endeavour t o use original equipm ent m anufact urer part s/equipm ent where feasible ▪ Supply you wit h a court esy car for t he durat ion of t he vehicle repair or unt il your policy expires, whichever is t he sooner (where t he vehicle involves is covered com prehensively) I f y our vehicle cannot be driven safely, y ou should allow us t he opport unit y of m oving it t o t he prem ises of an approved repairer or repairer of your choice if previously agreed by us. I f repairs are com plet ed wit hout our prior knowledge and consent t his m ay affect t he am ount we pay in final set t lem ent of your claim . I n all circum st ances, anyone conduct ing repairs t o an insured vehicle should ret ain t he following for our inspect ion: ▪ A fully cost ed est im at e ▪ All dam aged part s and ▪ I m ages of t he dam aged areas of t he insured vehicle I f y ou fail t o provide all request ed inform at ion, docum ent at ion and evidence of claim dam age, we reserve t he right not t o pay for dam ages under t his Sect ion. I f y ou choose t o not use our approved repairer, we will not : ▪ Be responsible for any delays incurred by t he repairer ▪ Guarant ee t he provision of a court esy car ▪ Guarant ee t he repairs ▪ Guarant ee t he use of original equipm ent m anufact urer paint/part s We m ay arrange for your vehicle t o go t o a repairer of our choice if we cannot reach an agreem ent wit h y our chosen repairer over cost s. I t is not our policy t o use recycled or non-original part s and equipm ent when repairing your vehicle, alt hough on occasion i t m ay be necessary. ERS POLICY DOCUMENT NUMBER ACFE 1020 12
Total loss When deciding whet her your vehicle is a t ot al loss, we use t he Associat ion of Brit ish I nsurers (ABI ) Code of Pract ice for t he Disposal of Mot or Vehicle Salvage. We alone will det erm ine: ▪ When an insured vehicle is deem ed a t otal loss ▪ The m arket value of t he insured vehicle; and where applicable ▪ Any salvage value of t hat insured vehicle I n t he event t hat we deem your vehicle a t ot al loss, due t o it being uneconom ical t o repair or subject t o an unrecovered t heft , we will, unless y ou qualify for a new van replacem ent benefit , offer an am ount in set t lem ent of t he claim . The insurance cover for t hat insured vehicle will end when you accept t hat offer. You will not receive a refund of prem ium if your insurance ends due t o t he t ot al loss of your vehicle. I f y our insurance covers m ore t han one vehicle, cover will rem ain in force for any vehicles t hat have not been declared a t ot al loss. I f t he insured vehicle is owned by som eone else, we will discuss t he valuat ion and pay m ent s direct ly wit h t he vehicle owner rat her t han wit h y ou. recom m ended ret ail price received at t he point of purchase. Our offer will not exceed t he am ount shown on schedule. Once we have m ade a paym ent , t he insured vehicle becom es our propert y unless we agree ot herwise. Vehicles subject t o a finance agreement I f t he m arket value we place upon t he insured vehicle is equal t o or great er t han t he am ount owed t o t he finance com pany: We will pay t he finance com pany first and t hen set t le t he balance wit h t he legal owner of t he insured vehicle. I f t he m arket value placed upon t he insured vehicle is less t han t he am ount owed t o t he finance com pany: We will pay t he finance com pany t he m arket value of t he insured vehicle. You m ay be required by t he finance com pany t o pay t hem t he balance, subject t o t he t erm s of your agreem ent wit h t hem . Vehicles subject t o a lease / hire agreement No legal right to title I f t he m arket value we place upon t he insured vehicle is great er t han t he am ount owed t o t he lease / hire com pany, we will pay t hem only t he am ount of t he out st anding finance, which will set t le t he claim in full. I f t he m arket value we place upon t he insured vehicle is less t han t he am ount owed, t he am ount we pay t o t he lease / hire com pany will set t le t he claim , and you m ay be required by t he lease / hire com pany t o pay t hem t he balance, subject t o t he t erm s of your agreem ent wit h t hem . Vehicles subject t o a lease / hire agreement Legal right to title or proceeds of sale We will pay t he lease / hire com pany t he m arket value of t he vehicle, which will set t le t he claim in full. Any t ransfer of legal t it le or dist ribut ion of t he proceeds of t he vehicle should be t aken up direct ly wit h t he lease / hire com pany in line wit h t he specific t erm s of your agreem ent . Salvage Where applicable, y our vehicle will have a salvage category placed upon it , in line wit h t he ABI Code of Pract ice. Only vehicles deem ed eligible t o go back on t he road can be considered for ret ent ion. I f ret ent ion is grant ed, t he value of t he salvage, as det erm ined by us, will be deduct ed from t he set t lem ent . At t he point of pay m ent t he vehicle will becom e our propert y unless we agree ot herwise. I f y our vehicle has been subject t o an insurance writ e off (t ot al loss), y ou m ust be able t o evidence t he vehicle has been rest ored t o a roadwort hy condit ion. I n t he event of t he insured vehicle being subject t o anot her claim , we will require docum ent ary evidence of repairs and ot her docum ent at ion as we m ay require, t o evidence, and t o sat isfy us, t hat t he insured vehicle has been m aint ained in a roadwort hy condit ion, ot herwise t he valuat ion will be affect ed. I f we ask, you m ust send us your vehicle regist rat ion docum ent (V5c), MOT cert ificate (if applicable), t he purchase receipt for t he vehicle, all keys and any ot her relevant docum ent at ion before we agree t o set t le t he claim . New vehicle replacement (commercial vehicles and cars only) I f y our vehicle is a privat e car or a com m ercial vehicle wit h a gross vehicle weight of 3.5 t onnes or less, we will replace i t wit h a new one of t he sam e m ake, m odel and specificat ion (if one is available) if it is less t han one year old from t he dat e of you buying it new and: ▪T ret ail price (including t axes) or ▪ I t is lost by t heft or is st olen and not recovered I f a vehicle is not available, we will pay an am ount equal t o t hat which was paid when y ou bought your vehicle or t he current t o us. We will only provide t his benefit if you ask for i t and anyone who has a financial int erest in t he vehicle agrees. Audio, visual, communicat ion, guidance or t racking equipment The cover provided by t his policy includes loss of, or dam age t o, perm anent ly fit t ed audio, visual, com m unicat ion, guidance or t racking equipm ent t hat form ed part of your vehicle when it was originally m ade. We will pay up t o £500 for any perm anent ly fit t ed equipm ent t hat was not part of your vehicle when it was originally m ade. We will also provide cover up t o £20,000 for accessories and spare part s (including GPS navigat ion syst em s) which relat e direct ly t o t he funct ion of your Agricult ural Vehicle. This includes cover whilst t hey are t em porarily rem oved from t he vehicle. The value of t his equipm ent m ust be included wit hin t he value of t he vehicle as declared in t he schedule. When your vehicle is being serviced The cover provided under t his sect ion will st ill apply when your vehicle is being serviced or repaired. While your vehicle is in t he hands of t he m ot or t rade for a servi ce or repair, we ignore any rest rict ions on driving or use (as shown on your cert ificate of m ot or insurance). Art iculated vehicles I f y our vehicle is art iculat ed, we will also insure any sem i -t railer against loss or dam age while it is at t ached or det ached from your vehicle, during t he course of a journey. I f t he com bined value of t he power unit and sem i -t railer is great er t han t he last t ot al value of your vehicle you t old us about (and we accept ed) we will only pay t he value shown in y our schedule. Agricultural t railers Where your vehicle is eit her: an agricult ural vehicle, a car or com m ercial vehicle, we will provide cover for any t railer whi ch is used only for agricult ural or forest ry purposes, and which is owned or cont rolled by you or for which you are legally responsible, against loss or dam age, while it is eit her at t ached t o, or det ached from , your vehicle. We will not pay any claim arising from t he following: ▪ Loss of or dam age t o any propert y bei ng carried in or on t he t railer ▪ Loss of or dam age t o any propert y being loaded on t o or unloaded from t he t railer ▪ Loss of or dam age t o any caravan or t railer carry ing liquid fuel, unless we agree ot herwise We will only provide t his cover if t he way you are t owing t he t railer keeps t o t he m a law.
