401 South Park Avenue • Winter Park, Florida 32789 Building & Permitting 407-599-3237 • 407-599-3499 fax cityofwinterpark.org Services TO: BOARD OF ADJUSTMENTS MEMBERS FROM: GEORGE WIGGINS, DIRECTOR OF BLDG/LEGISLATIVE AFFAIRS DATE: January 19, 2021 SUBJECT: VARIANCE REQUEST by Matthew Monroe in behalf of Joshua Gottschall, 441 Genius Drive The applicant is requesting variances to allow construction of a detached pool cabana with a roof height of 19 feet at the highest point and a side wall height of 12 feet, whereas the maximum allowed height is 18 feet at the roof top and 11 feet wall height respectively; and to allow the existing nonconforming two-story side setbacks of 10 feet, in lieu of the required side setbacks of 14 feet to the 1st floor and 19 feet to the 2nd floor, in order to permit the overall area of the cabana at 433 square feet. With the addition of a new swimming pool the applicant is seeking setback and height variances in order to construct a pool cabana in line with the architecture of the existing home. Although the maximum area of a cabana is permitted to be 500 square feet and the open area is permitted to be excluded from the allowable gross area of the home by up to 500 square feet, in this case the home area has already reached the maximum gross area permitted. In addition, under the current code only up 500 square feet of rear open or screened porch, or open cabana area can be excluded. The existing rear porch has an area of 322 square feet which only leaves an additional area of 118 square feet for the proposed partially open cabana. When the home was originally built in 2003, a total area of 900 square feet was permitted to be excluded from the gross floor area for rear porches, cabanas and similar structures. In order to consider allowing the additional floor area for a cabana with open and enclosed space of 433 square feet, an after the fact setback variance for the main residence must be granted, due to having 10 foot side setbacks on the main residence. Under the current code, the side setbacks are greater (14’ to first floor and 19 feet to the second floor) in order to permit this new area. Included in this variance request is the permission to a higher overall roof height to 19 feet and a higher side wall height to 12 feet although most of the cabana is open. Under today’s code the proposed side setback of 10 feet is permitted for a side wall which is 11 feet or less in height measured from existing grade to the top of the roof sheathing. This side setback encroachment issue and the excessive roof height of 19 feet could be cured by reducing the overall cabana height. This may be an area that the applicant may be willing to modify. Board of Adjustments - January 19, 2021 - 441 Genius Dr The location of this proposed cabana is on a lot which backs up to the Windsong Preserve which is a natural area not ever likely to be developed. In other areas of the City where a dwelling or accessory structures back up to non-residential properties, the rear setbacks are reduced to 10 feet for one or two story dwellings. In summary, the variances requested relate to the cabana’s building height, and the ability to recognize pre-existing non-conforming side setbacks on a home built at a time when a much larger area (900 square feet) could be excluded from the gross area of a home. December 28, 2020 Client: Envision Custom Homes Matt Monroe – President Central Florida Project: Gottschall Residence Subject: Variance Request To Whom it May Concern, This letter is to explain in additional detail the variance request to accompany the original online variance request submitted. Variance Request: Side yard setback to achieve additional 5% FAR allowance due to an existing non-conforming side yard setback along with 1’-2” encroachment into the rear setback. Response: The existing residence has a 17,583 square foot lot and an existing gross square footage of 6,292 with an FAR of 35.8%. Today’s building code provides an FAR limit of 33%. In order to do any additions to this property, a variance would be required due to the non-conforming side yard setbacks to allow this property to meet the requirements of the additional 5% FAR increase for a total lot FAR of 38%. The existing side yard setbacks are 10 feet on both sides of the first floor. The existing side yard setbacks for the second floor are 2’-6” on the south side and 5’-0” on the north side. In order to grant the additional 5% FAR, the first floor setbacks are required to be 14 feet on both sides or a total of 28 feet and for the second floor, 19 feet on both sides or a total of 38 feet. The existing first total setback is 20 feet and the second floor total setback is 27’-6”. The variance request for the side yard setback would be for 8 feet on the first floor and 9’-6” on the second. If the additional 5% FAR allowance is granted, it would allow the existing structure to then meet code requirements and allow for an additional 390 square feet of build. We are proposing a 433 square foot pool cabana in which 100 square feet is enclosed and 333 square feet is covered. This 100 square foot of enclosed new building would be done through the 390 square foot allowed as mentioned in the paragraph above. The code allows for 500 square feet of covered porch to be built in the rear yard. There is an existing covered rear porch of 322 square feet leaving a balance of 178 square feet of additional rear porch to be built. We would utilize this 178 square feet for our 333 square feet of covered cabana new build leaving Page 1 of 2
a balance of 155 square feet. We could accomplish this through the 390 square feet allotted with the additional 5% FAR or we can request to build this through an old code requirement. Previously the prior code allowed for 900 square feet of rear porches to be built. Our existing rear porch plus the new pool cabana would total 655 total square feet. This would be under the 900 square foot allotted to other homes built with this similar requirement at the time. Variance Request: New pool cabana to encroach 1’-2” into the rear setback. Response: The code allows for accessory structures to be built with 10 foot rear setbacks as long as these specific accessory structures meet certain wall heights and roof height limits. The plywood sheathing can be no taller than 11’-0” measured from grade and the roof can not be taller than 18’-0” when measured from grade. Our current structure measures 18’-11 5/8” from grade to top of roof. Our wall height measures 11’-11 3/4” above grade. This is so that we can match existing design elements and features from the existing structure. Because of our wall and roof height, we designed our structure to meet the primary residence setbacks of 25’-0” for the rear and 10’-0” for the side. There is a code to allow for a 10 foot rear setback if the residence is adjacent to a preservation. Though there is a preservation behind our residence, it is zoned as a single family lot. Our variance is to ask for one of two things. Either the allowable encroachment into the 25 foot rear setback by 1’-2” for a new setback of 23’-10” or for a variance for the building wall and roof heights.
