Missouri Supreme Court Rules Sheriffs' Retirement Court Costs Unconstitutional
In a case followed by and supported by an MML amicus filing, the Missouri Supreme Court
has ruled that a $3 court fee used to pay for sheriffs’ retirement is unconstitutional, which
was the League's desired outcome. Judges in a 6-0 decision issued Tuesday ruled that the
sheriffs’ retirement fund is not related to the administration of justice, meaning collecting
fees for that purpose is not allowed. The Supreme Court sent the case back to circuit court
for further proceedings including what will happen with refunds. Kudos to municipal judge
Frank Vatterott for supporting municipal courts on this important case.
