June 23, 2021: Newly Released Treasury Guidance Opens Doors for Expanded ARPA coverage of Policing In communities where an increase in violence or increased difficulty in accessing or providing services to respond to or mitigate the effects of violence, is a result of the pandemic they may use funds to address that harm. Hiring law enforcement officials – even above pre-pandemic levels – or paying overtime where the funds are directly focused on advancing community policing strategies in those communities experiencing an increase in gun violence associated with the pandemic; Community Violence Intervention (CVI) programs, including capacity building efforts at CVI programs like funding and training additional intervention workers; Additional enforcement efforts to reduce gun violence exacerbated by the pandemic, including prosecuting gun traffickers, dealers, and other parties contributing to the supply of crime guns, as well as collaborative federal, state, and local efforts to identify and address gun trafficking channels; Investing in technology and equipment to allow law enforcement to more efficiently and effectively respond to the rise in gun violence resulting from the pandemic. As discussed in the Interim Final Rule, uses of CSFRF/CLFRF funds that respond to an identified harm must be related and reasonably proportional to the extent and type of harm experienced; uses that bear no relation or are grossly disproportionate to the type or extent of harm experienced would not be eligible uses. ARPA Fiscal Recovery Funds Update: Reporting Requirements (NLC Recorded Webinar) On June 17, 2021, the U.S. Treasury released the Compliance and Reporting Guidance for the State and Local Fiscal Recovery Fund Program. The guidance provides additional detail and clarification for each recipient’s compliance and reporting responsibilities. In this recorded webinar, the National League of Cities (NLC) provides a high-level overview of the guidance and how to interpret it in concert with the Award Terms and Conditions, the authorizing statute, the Interim Final Rule (IFR), and other regulatory and statutory requirements. ARPA Announcement from the Missouri Office of Administration The state of Missouri has not received ARPA cash from the U.S. Treasury to distribute to cities (i.e. Non-entitlement units of Local Government) and likely will not for several weeks. However, if a city is interested in starting the process to receive funds, the following two documents are a couple of the U.S. Treasury requirements the state needs before payment can be made. This FAQ updates: Reporting requirements for the revenue loss/provision of government services eligible use category – providing that the revenue loss is to be calculated based on total revenue rather than source; Eligibility of public jobs programs; Addressing economic harms experienced by households, businesses, and individuals prior to March 3, 2021; Determining the eligibility of water and sewer projects; Covering costs of consultants to assist with managing and ministering the funds. Treasury has stated that they intend to update FAQs periodically to help clarify questions about the Interim Final Rule and anticipate another update soon. Further, the Interim Final Rule is still in the 60-day public comment period. Interested parties can submit comments for the record. Treasury has also updated the guidance for states regarding payments to cities. CDBG-CV (COVID-19) Application Cycle Now Open The Missouri Department of Economic Development's Community Development Block Grant (CDBG) program was allocated approximately $43 million to help communities across the state prevent, prepare for, and respond to the COVID-19 pandemic. Communities may apply for funding for eligible activities including public services, infrastructure, economic assistance, and planning. While activities can address a variety of unmet needs, they must be directly related to COVID-19. Applications will be accepted starting June 3, 2021 and will be accepted on a rolling basis until funds are depleted. The award nomination form with the criteria guidelines is linked here. In 2012, Missouri GFOA created the Excellence in Government Award. Noll Outstanding Assistant Award Collin Quigley, assistant city administrator for the city of Springfield, was chosen as the 2021 Richard R. Noll Outstanding Assistant Award by the Missouri City/County Management Association (MCMA). Quigley received the award at the Springfield City Council meeting this week. Quigley joined the city of Springfield as the assistant city manager in August 2007. In this role he is responsible for providing direction to and supervision of the functions and activities of the airport, art museum, emergency communications, fire, health, municipal court, parks, police and the workforce development departments. Congratulations Collin! Missouri Supreme Court Rules Sheriffs' Retirement Court Costs Unconstitutional In a case followed by and supported by an MML amicus filing, the Missouri Supreme Court has ruled that a $3 court fee used to pay for sheriffs’ retirement is unconstitutional, which was the League's desired outcome. Judges in a 6-0 decision issued Tuesday ruled that the sheriffs’ retirement fund is not related to the administration of justice, meaning collecting fees for that purpose is not allowed. The Supreme Court sent the case back to circuit court for further proceedings including what will happen with refunds. Kudos to municipal judge Frank Vatterott for supporting municipal courts on this important case. Missouri Broadband Resources Broadband Federal Funding Programs The federal government administers several programs through various agencies to fund investment in broadband infrastructure, equipment, access, and affordability. RAISE Transportation Grants Application Deadline: July 12, 2021 The U.S. Department of Transportation (DOT) today published a Notice of Funding Opportunity (NOFO) to apply for $1 billion in Fiscal Year (FY) 2021 discretionary grant funding through the Rebuilding American Infrastructure with Sustainability and Equity (RAISE) grants. RAISE, formerly known as BUILD and TIGER, has awarded over $8.935 billion in grants to projects in all 50 states, the District of Columbia and Puerto Rico since 2009. Projects for RAISE funding will be evaluated based on merit criteria that include safety, environmental sustainability, quality of life, economic competitiveness, state of good repair, innovation, and partnership. Within these criteria, the Department will prioritize projects that can demonstrate improvements to racial equity, reduce impacts of climate change and create good-paying jobs. Learn more and apply.
